TOWN OF TEXAS PLANNING COMMISSION MEETING

OCTOBER 2, 2017

TOWN MUNICIPAL CENTER

Meeting was called to order by James Burgener.  Roll call was taken by Clerk. 

Minutes of September meeting were read by the Clerk. Motion by Bill Schwede to approve.  Second by Janet Sann and carried.

CHAIR REPORT- Jim reported that he had read through ordinances for any answer to the question of weed control.  Jim says there is nothing in the Town ordinances, so any law would fall back to the State Statutes.  If we want to revisit, Delmar should request to have it placed on a future agenda.

TOWN BOARD CHAIR-Delmar reported on Safer talking about ambulance at Maine location.  Maine says the new contract is for 5 years.  Betty wants only a 2 year contract.   Macomber still working on his junk issues.   Garbage and Recycling contract needs to be renegotiated.  

CLERK REPORT- Clerk questioned some permits and payments.  Dick Kurth paid the permit fee but the permit didn’t get approval.  Also Schefelbien paid but did not get approval.  It was brought by Ray in July but there was not quorum.

ZONING INSPECTOR REPORT-Ray presented zoning permits.  Paul Anderson moved to approve Kurth’s permit.  Second by Jim Palmer and carried.  Jim Palmer moved to approve the Schefelbien permit.  Seconded by Paul Anderson and carried.  T-Mobile equipment shed application and documentation was reviewed.  Bill Schwede moved to approve, second by Philip Walters and carried.  The Application amendment noted Town of Texas, Marathon County and not City of Wausau, Hennepin County.

DISCUSSION OF PROPERTIES NOT IN COMPLIANCE-see above

BUSINESS- OLD AND NEW- Andy noted that the State of Wisconsin budget contains approximately $600,000 per year for 5years to aid in costs of the Cooperative Boundary Agreement.  The Oversite Committee will need to discuss what share is the Town of Texas and when we get some reimbursement.

Minutes of August meeting were read by the Clerk. Motion by Bill Schwede to approve.  Second by Janet Sann and carried.


CHAIR REPORT- Items will be discussed in the agenda.


TOWN BOARD CHAIR Delmar contacted Macomber in person.  His work schedule would make it very difficult to make it to a meeting.  He is hauling tires to Antigo, Freon is removed from any refrigeration units before he receives them, has stuff for sale in yard.  Will look better in winter and will try to work with the Town.   Cleveland has posts and bracing up to house vehicles when shed is done.  Dombrowsky doesn’t have a permit through the Commission, but his son says the Ray has been contacted.  Goetsch Road houses and the Restlawn Cemetery have issues with the lot line.  Ray is trying to help them with the issues.  Delmar also noted that the gas lines from Evergreen Rd to Brokaw Corners will be worked on per a letter.

Motion by Bill Schwede to approve all permits.  Second by Paul Anderson and carried.


Permit for Dick Kurth on Green Valley was questioned.  Ray said he has permit, but clerk wasn’t sure.  It will be checked on.


Ray also noted the issues between Goetsch residents and the Cemetery.  There are sheds and garages around 15 feet over the lines. Ray will try to work with them.

BUSINESS- OLD AND NEW- Andy from the OSC said that there will be a meeting between the Villages, Town, Mathy Construction and County to discuss the Boat landing and potential park.  Shane will meet with Betty, the County and Mathy also. 


The other Brokaw issue is a Conditional Use Permit for Hartland Cooperative that purchased the Grain bins and didn’t realize about the conditions and was blind sited.  They need to run longer than the permit had been.  It is a Brokaw Issue but the OSC has final approval.


Next Oversite Committee is scheduled for October 3, 2017 at Village hall. Time to be announced.


Maine is meeting with Safer because the City terminated the Emergency contract with Maine.  Texas Clerk receive a termination letter also.  Town Board will discuss further.


Note that the Planning Commission moved to approve the map zoning change at the Public Hearing and forward to Town Board for action

Meeting was called to order by James Burgener.  Roll call was taken by Clerk. 

No minutes were read.  No Quorum was present in July.

CHAIR REPORT-The Commission should consider a Public Hearing on correcting the Zoning Map for the Granite Heights area which was changed during the Zoning rewrite.


TOWN CHAIR REPORT-Delmar talked about issues with properties out of compliance.  Macomber has been hard to reach due to his work schedule for contact.  Delmar will continue to try to contact him about the accumulation of various items on the property.  Scott Cleveland has begun his shed that should house some of the vehicles on his property.  Kasys’s has been cleanup and is for sale at bottom of Marshall Hill.


CLERK REPORT- A culvert and turn around have been discussed for the end of N 81st Street where a home is being built.


ZONING INSPECTOR REPORT-Ray was not in attendance but had left a message with the clerk.  He is working on several building permits.


A permit was applied for by James Burgener for a 12x20 shed on Quarry Road.  After review of the application a motion was made by Paul Anderson to approve. Second by Bill Schwede and carried.


REVIEW AND DISCUSSION QUESTIONS BY PROPERTY OWNERS-A fire work permit was noted for Dr Webb.  It will be on the Town Board agenda.


DISCUSSION OF PROPERTIES NOT IN COMPLIANCE-see above


BUSINESS- OLD AND NEW- A motion by Paul Anderson to set a Public Hearing for September 11th at 6:30 PM to correct the zoning for Granite Heights Subdivision across the tracks.  The map had an error that did not make the area Residential during the rewrite.  The area had been residential for many years, and should have continued to be on the Zoning Map.  Second by Bill Schwede and carried.


Andy as the OSC representative stated that the Boat Landing by Brokaw is an issue.  Marathon County and Mathy construction want to correct a CSM for the landing.  Mathy is cutting pulp on three 40’s and will be hauling on the current access road.  More discussions to follow. 


The OSC discussed the Administrator.  Duane Gau will be replaced by Keith Rusch if the committee will approve.  Keith would then resign as the Village of Maine Trustee.


The Public Hearing is set for 6:30 PM on the 11th, with the Planning Commission to follow.  The Town Board will then follow both.

CHAIR REPORT-Quarry Road is having borings done by Riverview Testing for Public Service.

TOWN CHAIR REPORT-Delmar talked to Jarntowski about junk cars.  He plans on getting rid of 4 and restoring 4 when he retires.  Macomber has been cleaning and working on his issue.  Virgil Kays at T 5328 County Road W has been cleaned up and all car removed.  Krueger doesn’t look too bad and can’t see cars way in back due to tall grass.

CLERK REPORT- No report

ZONING INSPECTOR REPORT-Ray reported permit for Dan and Kathy Hornung at T9954 County Road J for house at former Luella Mueller property. $125 to Marian.  Todd Paul at T8748 Quarry Road for garage  $45 will be dropped by Marian.  Schefelbein will not start until next summer.  Paul Anderson moved to approve of both permits.  Second by Jim Burgener and carried.

REVIEW AND DISCUSSION QUESTIONS BY PROPERTY OWNERS-Cleveland came to discuss car issues.  He has many cars but thinks they will fit when the new shed is built.  Paul Anderson questioned if the permit is still valid.

DISCUSSION OF PROPERTIES NOT IN COMPLIANCE-see above

BUSINESS- OLD AND NEW- Motion by Paul Anderson to recommend to the Town Board that a letter be sent to the County Treasurer requesting information on tax deeds process for the Adeline Krause and Wasmundt properties.  Second by Janet Sann and carried.  The Town has had complaints on the properties.

Meeting date for the July meeting was discussed due to the 4th on Tuesday and many taking the 3rd off also.  Group set date for 6:30 PM prior to the Town Board meeting on Monday July 10th.

Minutes from April were read by clerk.  Paul Anderson requested the minutes show an address for the Ferge property as he felt the minute’s description was misleading.   Motion by Bill Schwede to approve the minutes and have clerk include an address.  Second by James Palmer and carried.  The Address is T12529 Shady Lane Road for the Ferge property.

CHAIR REPORT-No special report

TOWN CHAIR REPORT-Wayde Kreager has questioned what is happening with the Wasmundt properties at T13063 and T13065 County Road W.  Wayde purchased land next to the properties and has issues with people dumping on them and messes left on the property.

Adeline Krause property at T701 Marshall Hill Road was discussed because of complaints on the condition.

Both parcels have delinquent taxes for enough years that the county could take the properties.

CLERK REPORT- No report

ZONING INSPECTOR REPORT-Ray reported that he was working on two permits.  Todd Paul on Quarry Road and Kathy Hornung on County Road J.

REVIEW AND DISCUSSION QUESTIONS BY PROPERTY OWNERS- Randy Block presented a CSM of 5 acres on the northwest corner of N 97th Street and Green Vally Road.  Currently owned by KKB Income Trust.  Motion to approve by Bill Scwede, second by James Palmer and carried.

DISCUSSION OF PROPERTIES NOT IN COMPLIANCE-Paul Anderson made a motion to have certified letters sent to Cleveland, Krueger, and Zemke and Macomber (although he had a verbal cleanup) Second by Keith Plautz and carried.

BUSINESS- OLD AND NEW- Marian reported that the dogs have been licensed by Beau Corey.  There is no longer a problem.

Minutes from February were read by clerk. A couple of corrections were noted by the clerk.    Motion by Andy Walters to approve minutes with the corrections.  Second by James Palmer and carried.


CHAIR REPORT-No special report


CLERK REPORT- Lorraine noted a problem with the initial attachment area because of the strip of property that Attorney Deffner has.  It was on the map but wasn’t listed as a parcel in the attachment.  A surveyor is trying to do a survey to correct the area, but isn’t sure which municipality has jurisdiction.


TOWN CHAIR REPORT-Matt has requested that Shane prepare letters for non-compliance.  He tried to call Macomber but didn’t get an answer.  He will try more. Matt also noted that Janet Sann is interested in being appointed to the Committee.


ZONING INSPECTOR REPORT-Ray attended and didn’t have any new permits, but the following are potentials.  Doug Zemke, Sandra Ferge, Jesse Schefelbien, and Milt Schultz.


REVIEW AND DISCUSSION QUESTIONS BY PROPERTY OWNERS-Clerk noted that she was contacted about a potential auto repair business at T16295 County Road WW N.  It is currently AG zoned.  The residents would need to contact the committee for further information on zoning requirements.


DISCUSSION OF PROPERTIES NOT IN COMPLIANCE-  No other action at this point.  Waiting for the Attorney to send letters.


BUSINESS- OLD AND NEW-Discussion and review of town roads that needed to be renamed.  Matt felt that the County has not given board members all the information prior to the vote for the Readdressing.  Now the county says that they will hire a contractor to place all number and street signs at municipal expense except for the $20 per number signs.  It is one more hardship for the Town of Texas with the Brokaw hardship.


Discussion and review of the recommended amendments.  Business signs were discussed more.  Many are not in compliance, but Board doesn’t receive complaints.  Someone would have to drive the Town and make a list of non-compliance and take pictures, if we wanted to take action.  Andy Walters said let’s deal with complaints and leave as is for now.  Matt said that is how he worked out sign issues.


Animal units were an issue discussed but Jim Burgener said that the list is by administrative rule.  If it is a large operation, the county gets involved with waste plans.  He recommended to leave as it and work with the county if any large operations develop.


Set back at building site was discussed because it seems excessive.  Matt said that it was a concession when the ordinance was rewritten because of lot sizes.


Those amendments approved by members will be submitted to a Public Hearing April 3, 2017 at 7:00 PM before the regular Planning Commission meeting.  Motion by Philip Walters, second by Bill Schwede to set the meeting.  Amendments will be attached to these clerk minutes.

CHAIR REPORT- Discussed that neighbors in area by Macombers have requested that either get it cleaned up or force them to fence the “stuff”.  Matt Bootz will talk with Macomber about the issue


CLERK REPORT- Noted closure document from Expera for Cell 4A.  Clerk will turn over to Melessa at the County Solid Waste dept for comment.  Clerk also noted that the Village of Maine had sent a copy of the Initial Attachment area north of Evergreen Road.  North Central Planning Commission gave notice of the City of Wausau adoption of a revised Comprehensive Plan.


TOWN CHAIR REPORT-Matt reported that the Towns and Village hired Vierbecher and not Becher-Hoppe because of conflicts of interest.  Becher-Hoppe worked with the City of Wausau.  Also Joe Gehin now works for Becher Hoppe and is a former employee of the City of Wausau.


The question of using the City of Wausau water until the Village can provide water would be up to the PSC.  It would have to be by court order that the City continue to provide water.


The Cooperative Boundary agreement provides that the Town and Village provide for maintenance of current services.  If the Village of Maine wants to drill wells etc, the Town of Texas does not need to help in cost of Capital Improvements.


Noted that agendas of the Advisory Committee should have a public comment section.

ZONING INSPECTOR –Wasmundt moved vehicles around but didn’t really remove any on the Zemke property on River Hills Road.  Judy Allman said steel prices so low that junk companies don’t want any vehicles now.  Town will wait to spring and Matt or new Chair will contact him again

ZONING INSPECTOR –Ray reported that Jim Madden on Granite Road is working to get an extra garage permit.  Ray said he needed to collect the permit fee from Frenzel.  Jesse Schefilbien needs high water mark off of N 81st Street north of Rocky Ridge Road.  He has 80 acres.

A discussion was held on post steel houses.  Jim read the code about houses and didn’t feel that our ordinance specifically restricts or has any issue on them.  Town of Wausau has had issues when people put up the home but didn’t do the landscaping as shown on pictures.

Andy Walters asked about a permit for E Marshall Hill Road.  Either a rough shed or blind.  Ray will check on status. 

Andy questioned why the Village of Maine is using the most expensive engineer firm from Madison, rather than using local firms that have previous studies and information on the area.

CLERK REPORT- Noticed the fact that the City of Wausau filed a suit against the Department of Administration for approving the CBA.

REVIEW AND DISCUSSION QUESTIONS BY PROPERTY OWNERS-Delmar questioned why the City of Wausau charges $60.00 for dog licenses.  Clerk believes they can set the price and they use a company from Texas to do licensing on line.

Roger Rhyner asked about splitting his property.  He is in Ag Zone and only has 5 acres so it would not meet the Zoning requirement of 3 acres.

Andy Walters stated that the Town Board needs a plan or who decides on culvert placement and need. 

Clerk recommended that we require property owners planning on building houses  to attend a Planning Commission meeting prior to Zoning Inspector granting a permit.  This was an established requirement in the past.  This could prevent issues with culverts and other problems in future.  It also helps everyone get to know each other. 

Jim Burgener moved to recommend a check off on zoning permit for culvert requirements and the Town Board assign a person to make the culvert decision.  Second by Andrew Walters and carried.

ZONING INSPECTOR –Ray reported that Dale Tollar had his property surveyed and will sell house, keep property for shed and then a one level house.

REVIEW AND DISCUSSION QUESTIONS BY PROPERTY OWNERS-Connie Winter had talked to Andy Walters about dividing their property.   It is considered 6 acres on tax bill but there isn’t a survey and may be short of two 3 acre parcels.  It is zoned residential.  If zoned residential, then lots are required to be one acre and not 3 like in Ag zoning.

Delmar asked about a new rood on a shed that may be too close to lot line.  Maintenance of an existing structure is ok.  Any size changes would need a permit and the addition would need to conform to set backs.

The culvert issue was reviewed.  The Commission felt that the water does not go on road.  The water just crosses the private driveway that the town should bill for culvert, but not be concerned with issue.

ZONING INSPECTOR – Ray had been contacted by David and Donna Kutil.  They have a problem with their property.  They received a letter from Attorney Deffner that their garage and driveway are on his property.  He purchased a property strip from Morgans that had been a gap when properties were sold originally.  He purchased the strip for $500 and wants them to pay $5000 or he will require them to move their garage.  The strip does not have a CSM so Ray is unsure where the lot lines are.  Ray will work with the residents on the problem.

Adam Walters applied for a shed permit at T7524 Stone Road.  Motion to approve by Paul Anderson, second by Bill Schwede and carried.

Wayde Kreager applied for a permit for a business shed on Wisconsin River Road to expand the current storage shed.  Adam Walters moved to approve, second by Bill Schwede. Paul Anderson opposed, but motion carried.

Jim had reviewed the County Zoning Ordinance rewrite and didn’t find any significant changes.  Mostly different format and title changes.  Doesn’t think that the Town needs to follow through a complete change, but town ordinance needs to be reviewed for other potential changes as seen necessary by the commission.

Chair Burgener said that he wants to do a side by side comparison of the updated and adopted County Zoning Ordinance and the Town of Texas current Zoning Ordinance before the Commission considers potential amendments.

Chair Burgener also plans on discussing with Ms Fritsch the potential county support for the Cooperative Boundary Agreement between Village of Maine, Town of Texas, and Village of Brokaw.

REVIEW AND DISCUSS QUESTIONS BY PROPERTY OWNERS-The Commission had a hearing on a request for a dog kennel prior to meeting.  Commission voted to recommend to the Town Board to deny the request.   No other owners had questions.

ZONING INSPECTOR – Ray didn’t have permits yet.  He is still working on several.

OTHER ISSUES- Zemke yard and car collection still a problem.  Cleveland collection of cars also a problem.  It appears from reports that more were brought in even with road limits.  Paul Anderson made a motion to recommend that Town Board visit and discuss cleaning up the mess.  Permits were given for a shed, but the expiration may have past.  Second by Bill Schwede and carried.

Clerk reported that Arndt called about the Taschler building potential for cheerleading training and exercise.  Bil Schwede Fire Chief said inspections are being completed for all buildings.  Commericial zoning will be fine if leased.

Discussion on amendments to Zoning Ordinance and whether we want to be serious and start a policy of 5 pages or ½ hour per meeting.  Then a hearing for proposed changes after six months to beginning making changes.  One issue is side yards—each side or cumulative.

REVIEW AND DISCUSS QUESTIONS BY PROPERTY OWNERS-The Commission allowed Jason Weister of AARIS to discuss internet access to town residents if enough were interested.  Some areas of the town are in dead zones.  His company would need 40-50 households in order to expand into the Town of Texas and make it financially positive.

No other owner had questions.

ZONING INSPECTOR – Jess Kufahl applied for garage permit for Molitor at T12411 N 73rd ST.   Burgener had read the ordinances and discussed with Commission members that the stairway is a landing with a permanent awning and could be considered as such under the zoning ordinance.  If the members approved then we would not have an issue with the location.  Motion to approve by Paul Anderson, second by Keith Plautz and carried.  Andy Walters questioned then if anyone can have a roof or awning within 3 feet of lot line in the future.

Stan Sobiesczk applied for a pole shed.  Motion to approve by Bill Schwede.  Second by Andy Walters and carried.

Ray stopped at Zemkes and left information about codes including vehicles and side yards.

OTHER ISSUES- Members discussed issues with the implementation of a new address system in the county.  The sheriff department feels necessary for safety, but doesn’t think of all of the other issues involved.

Town chair wants to meet with the Commission members to review issues on the Cooperative Boundary Agreement for Brokaw.  Members are not available for 4:30 pm but would be at 5:30 pm Clerk will talk to Chair and send email information to members.

REVIEW AND DISCUSS QUESTIONS BY PROPERTY OWNERS-Rhonda Singstock attended to discuss a conditional use permit for harboring more than 3 dogs.  She would like a kennel license for property east of T13063 County Road W.  Eventually a house would be built also.  Currently lives in City of Schofield.  The dogs are small Shih Tzu’s that would be taken care of inside.  Letters will be sent to parties of interest after application is received.  She is in process of purchasing of the property so Marathon Savings Bank will need to apply.

ZONING INSPECTOR – Dennis Weinkauf has a new number.  Ray will contact again. 

Jess Kufahl will be contacted by Ray to discuss garage at T12411 N 73rd ST.  The porch is also not in compliance with ordinances.

Wade Kreager- Needs information on signs and set back for storage unit.

OTHER ISSUES-Lynn Taschler had talked about zoning of his parcel on Evergreen Road. His property is currently zoned M1 and should be C1.  He has an interested party in a purchase for a truck snowmobile repair shop.    Jeff Plautz property also should be C1 and not M1.  There are concerns for rezoning since these properties are across Evergreen Road from the City of Wausau .

Copies of the proposed Cooperative Boundary Agreement were dispersed to members and interested residents in attendance.  Everyone had lots of questions.  The Hearing is scheduled for February 10th at 7pm in the Wausau West Auditorium.

REVIEW AND DISCUSS QUESTIONS BY PROPERTY OWNERS-Gary Bootz, provided copies of a CSM of the Elmer Bootz property that changed the driveway access to provide both the home and farm property access from one driveway.

Ron Carpenter’s map for consideration was provided.  It appeared that land would have a land locked parcel.  The lots would be more than 3 acres, the maps didn’t provide information about road frontage.  A shared driveway would need 100 feet between existing driveways with a 25 foot distance from each existing property line.

ZOING INSPECTOR – Dennis Weinkauf has a new number.  Ray will contact again. 

Dale Doering applied for a permit for a Deck. Paul Anderson moved to approve.  Second by  Keith  Plautz and carried.

Thomas Cloutier applied for a permit for a shed at T4404 County Road W.  Motion by Paul Anderson. Second by Keith Plautz and carried.

Molitor had not signed a permit.  The Commission had questions on the measurements on the permit.

REVIEW AND DISCUSS QUESTIONS BY PROPERTY OWNERS-Delmar questioned if Steber on Granite Heights could put a camper on the property for 60 days and then remove for a week and bring it back.  Jim said the ordinance is for 60 days per year, so that would not be according to ordinance.

Andy talked with Ron Carpenter about a private street off of Shady Lane Rd.  Andy is not sure that there is enough space for one driveway between Carpenter and Smail.  It was not part of the survey so measurements are not known.

ZONING INSPECTOR-Weinkauf still hasn’t gotten a building permit for the tarp shed.

N 73rd Street shed-Jess Kufahl will meet with Ray next weekend.  He wants to add another shed.

Taschler on Evergreen Road is talking about someone wants to purchase his property and sell used cars.  It is Commercial zoning but may need a hearing.

N 73rd Street former Kittel house on corner with River Hills Road has a new garage and porch.  Ray says no permit has been issued or requested.

OTHER ISSUES-Philip asked about auto shops and disposal of fluids.  Scott Cleveland has been adding more vehicles to his property.

Jim says the new director of County Planning and Zoning is working on re-addressing of the county, and redoing the County Zoning Ordinance.

McCumber on Quarry Road and his junk was questioned.  It seems to move in and out frequently and not just a stock pile.

Paul Anderson asked how do we enforce one and not the rest.  Jim said it is on complaint basis usually.

REVIEW AND DISCUSS QUESTIONS BY PROPERTY OWNERS-Maggie Steber attended with questions on a lot in Granite Heights and what could be built on it and what regulations would be on the property.  It is in a flood plain and an odd size.  The current zoning map shows as Ag not Residential which probably was an error during Zoning Changes in 2007 with a new map. However with the current zoning, 30 foot set backs would be required, and size of lot would not permit a building.  She also asked about a camper on the lot from Memorial  Day to Labor Day.  The zoning ordinance allows for 60 days.

The survey map of Ron Carpenters needed an approval for the County.  Motion by Paul Anderson to approve.  Second by Bill Schwede and carried.  It was signed by Commission Chair for clerk to send back to REI.

 ZONING INSPECTOR- Three permit applications were reviewed.  Paul Anderson moved to approve a permit for a house and garage for Benjamin and Kristin Gille T899 Castle Rock Ln. Second by Andy Walters and carried. 

Paul Anderson moved to approve a permit for a detached garage at T8752 County Road W for Koua Chang.   Set backs were met for the permit per Ray Rogers since we had set back issues on this property before.  Ray assured the setbacks are in compliance.  Second by Bill Schwede and carried.

OTHER ISSUES-Ron Carpenter asked about a road to his back 40 acres and how many houses could be on a private road.  What would the process be to turn it over to the Town?  A Town road has to built to Town Specs including blacktop.  Lots need to have town road access.

 ZONING INSPECTOR-No reports tonight.  Waiting for Weinkauf to call.

OTHER ISSUES-Wally had question about a 14x70 ft trailer that was older than 5 years.  Could it be used for storage in the Town of Texas.  Ray said rules are strict and can not be moved into the Town for storage.  Question from T 4401 Town Hall Road.

Ron Carpenter asked about  creating 4 acre lots and will contact REI for surveys to create the lots.

Building on N 73rd Street with no permit will be contacted by Ray.

Dan Krall questioned members about building a shed for his construction business on East Marshall Hill Road on 3.7 acres without building a house.  Chair reported it is a residential district and would not allow a shed before a home.

Chair Burgener said if the Town wants to amend its ordinance to resemble the County’s updates that he would help in Schwede. Second by Philip Walters and carried.

CLERK REPORT- Clerk reported on the County Zoning Revision that was presented at the Joint Towns Association meeting.  General consensus to stay with local zoning but do some revisions to keep current with the county.

 ZONING INSPECTOR-Ray reported no new permits, but lots of questions.

OTHER ISSUES-The CSM of the Borchardt property had been received so the committee members reviewed it.

Weinkauf issue still on table.  Ray needs to work on the issue.

Building on N 73rd St without a permit needs to be contacted.  Ray has tried several times.

Other properties to continue reviewing are T180 County Road WW and T170 Marshall Hill Rd

No other discussion on the Comprehensive Plan or potential zoning ordinance changes.

 ZONING INSPECTOR-Ray was not in attendance.

OTHER  ISSUES-Kenneth Borchardt attended to discuss selling the Wausau Hardware and Machine building to his son.  He and his wife discussed the issue of the need to separate the lot from the house, but it could not be a straight line due to the well location that needs to be included with the house.  After much discussion and reading, Philip Walters made a motion to have Borchardt’s  have a CSM created between the house and shop with 20 foot side yards and not add any acreage to the shop as M1 only requires 20,000 sq feet.  Second by Paul Anderson and carried.

Adeline Krause property at T170 Marshall Hill Road has created complaints.  She is in a nursing home and the bank has not taken any action.  The County can resend and publish applications for tax deed.  Matt has been in contact with Audrey Jensen the new county treasurer about the property and tax deed process.

Complaints have been received on the property at T180 County Road WW due to accumulation of junk.  The property will be reviewed.

Weinkauf issue still on table.  Ray needs to work on the issue.

Delmar reported that a lady from River Hills Road had called about a fence and distance from the road.  Delmar told her that the road has a 66 foot right of way, so 33’ from center of road is ok for the fence.

No other discussion on the Comprehensive Plan or potential zoning ordinance changes.

CHAIR REPORT-Matt reported that a closed meeting would be held on Thursday June 5th at 3 PM to discuss the Brokaw issue.  After the meeting, a public meeting will be scheduled to lay out various options to the town residents for input on three options.  Should the town work with the City of Wausau on a Boundary agreement, work with the Town of Maine and Village of Brokaw on an agreement, or try litigation on illegal tax and state statute.

Town ordinance 17.43 should be reviewed on Gardening and Farming.  When can residents have animals like chickens.  Revisit poultry and stock farms and definitions.

CLERK REPORT- Nothing special

 ZONING INSPECTOR-Two permit applications were received.  Morenti  for camp off of Blessing Road.  Motion to approve by Philip Walters, second by Andrew Walters and carried.

Richard Burch for a storage shed.  Motion to approve by Paul Anderson, second by Andrew Walters and carried.

There is a new shed on 73rd St across from Lockwood Lane without a permit.  Ray will contact property owner for a permit.

OTHER  ISSUES-Delmar reported that Ron Carpenter could like an additional culvert.  He has acreage, but culvert distances will need to be reviewed.

John Allman would like to be considered for the planning Commission.  Matt would like to get off of the Commission and have a citizen committee, especially with the Brokaw Issue taking so much time.

CHAIR REPORT-Matt reported that a side committee may develop over the Brokaw issue, it would not be a Town Committee.  Matt is still waiting for real numbers and how debt would be divided under a dissolution of the Village.   Matt and Attorney Vanderwaal met with the State Department of Administration to discuss issues without any commitment from the Department.  Senator Pietrowski  believes that the City of Wausau needs to be  involved.   Matt met with Keene Winters from the City and other meetings with City officials will be scheduled.

CLERK REPORT- Nothing special

 ZONING INSPECTOR-Couple of properties need to be reviewed.  Issues beginning with the Brodjeski property,  former Hilgeman’s  property on corner of Skyline and N Troy Street .  Matt and Ray will review and will be on next  month’s agenda.

Randy Knutson T 180 County Road WW had questions of raising pigs for home use.  Also question on dog licenses in the town.

Zoning Permits- Joyce Kreager. Shed addition $25.   Motion to approve by Andy Walters, Second by Matthew Bootz and carried.

OTHER  ISSUES-Boat landing in Granite Heights is on Subdivision  map,  but not on State highway aids map.  Parking on road side on former Kittel House on N 73rd St could be problem,  Trappe River S curves on County Road W during fishing season is a problem.  Matt will talk to County Park Department.

CHAIR REPORT-Matt reported that Robert Zimmerman and Len Wurman both of North Troy St want Matt to consider a citizen committee for the Brokaw Issue.  The Town Chairs and Attorneys with meet with the Department of Administration in Madison about issues with Brokaw and potential law changes needed.  The Towns will also meet with City of Wausau representatives to consider Cooperative Boundary Agreements.  Matt is concerned that Maine is not interested in any annexation or boundary agreements.  Matt will consider the citizen committee after the election.

CLERK REPORT- The County Comprehensive Plan meeting schedule was presented for interested parties.

 ZONING INSPECTOR-Ray was not in attendance. Questions about the Croker shed were brought up.  The shed has separate septic and was built before UDC regulations.

Compliance issues-Nothing new at this time.

The Committee should review the Comprehensive Plan, but will not work the plan on until the Brokaw Issue is settled or calms down.  The Comprehensive Plan could be obsolete with whatever happens with Brokaw.

When the committee looks at the Zoning ordinance, side yard variances in residential areas needs to be reviewed.   Calculations for animal units per acre and what size parcels can have animals needs to be reviewed and possible changes.

MARCH 2, 2015

Meeting was called to order by Chair Bootz.

Minutes from December were read by clerk.  Motion to approve by Matt Bootz, second by Andy Walters and carried.  January meeting was canceled and February was short of a quorum so there were not any minutes.

CHAIR REPORT-Matt reported that Attorney Dietrich says the City is only interested in Brokaw for economic development.  The Board has met with the Town of Stettin several times and gone into closed session since some information could be confidential with the Attorneys.  There will be a Question and Answer meeting held for both Towns.  There is no solution yet, but all potentials are being reviewed.

ZONING INSPECTOR-Potential purchasers of  T7420 Steel Lane attended to question if they could add a culvert, divide the property and put up some storage units.  Ray will have to work with them on side and rear yard measurements.  Ray said Cloutier’s shed at T4404 County Road W  is ok and was permitted when Stumpner’s shed was.  He is currently working with Madden on Granite Road for permits.

The Town Board opened Buck Trail and N 33rd St for ATV and UTV’s temporarily until after the April Election per Town Meeting.
