Town of Texas Town Board Meeting


September 11, 2017


Town of Texas Town Municipal Center

Meeting called to order by Delmar Winter at 7:26 PM. Roll call was answered by Delmar, Wally and Andy.


Andy Walters moved to approve the minutes with name correction of Wally Borchardt not Walters in the motion to adjourn.   Second by Wally Borchardt and the motion carried.


Treasurer report was given by Treasurer Matsche.  Delmar Winter moved to accept and file for audit.  Second by Wally Borchardt and carried.


CHAIR REPORT –Delmar reported that the rope for the flag has been replaced, culvert place on N 81st St, ditch cleaning on 73rd, and 33rd Streets were done.  Beat up replaced culverts from River Hills have no value and would be disposed of, but Gohdes would like them.    Delmar noted that the Village of Maine adopted and ordinance to open all roads to ATV’s and UTV’s.  Berlin also opened to all.  The Snowjet club asked about all of the Town of Texas roads instead of the current one at a time.  We would need a new hearing and ordinance change.


SUPERVISOR REPORTS-Wally reported that there is an issue with a culvert at Copenhaver’s on Pine Bluff Rd.  No culvert has been on that property and if Copenhaver feels that he needs one, it would be his responsibility and not the towns.  The Town will not pay for a culvert.  Andy reported that the blacktopping of River Hills Rd has been postponed due to rainy weather.  Hopefully by end of September or early October, the project will be completed.   If not done by then, it may need to be postponed until spring.


CLERK REPORT- nothing special


OLD BUSINESS-Driveway culverts were discussed in the road maintenance portion of the agenda.  Discussion if we need a better method of culvert application.  If new construction applicants need to meet the Planning Commission as in the past, a number of issues could be discussed including the culvert application.  Paul Anderson noted that a culvert was put in for the Revie property for ease during logging and is non-compliant and needs to be removed. 


Road equipment was discussed.  Braces on the loader bucket are rusting through from the inside and need to be replaced.  Kevin and Delmar will check on pricing.


Andy’s report on the OSC meetings need no action.  A meeting was held with County Board Supervisors Bootz and Gibbs hoping that the County Board will adopt a resolution in support of the Cooperative Boundary Agreement.  Also Andy noted that the Village of Maine is in discussions with SAFER about ambulance service since the City of Wausau has terminated their current contract.  The City will provide service under a new contract if necessary.


The Clerk presented a new Recycling Ordinance to replace the old one.  A motion was made to sign the extension of contract with IROW by Andy Walters, second by Walter Borchardt and carried.  A motion was made by Delmar Winter to sign the Memorandum of Understanding with the Marathon County Solid Waste Department to continue our disposal at their site by IROW.


A loan from the Board of Commissioner of Public Lands was tabled for a month.


The recommendation of the Planning Commission to the Board to amend the Zoning Map for the area of the Granite Heights Subdivision was reviewed.  The rezone of the map would change the area from A1 Agriculture to R1 Residential like it was prior to the September 2007 revision.  It is believed that the area was unintentionally missed on the revision map.  Residents that attended the Zoning change hearing were in support of the change.  Motion by Delmar Winter to approve submitting the request to the Marathon County Board for approval.  Second by Walter Borchardt and carried.


The parcel combination for for Ron Bootz was signed by the Chair and clerk will send to assessor.


Delmar Winter discussed culvert replacements needed for 2018. Three culverts would need replacement 2 on N 97th St and one on Pine Bluff Road.    Andy moved to submit applications to Marathon County for the 50/50 match of Bridge and Culvert Aid.   Second by Wally and carried.  Delmar and Kevin will get pricing information for the Clerk to submit to the County.


Note that the Courts upheld the County readdressing for the Town of Rib Mountain so Marathon County can bids for street and address signs.  Various discussions about address changing and the complications for the


FIRE DEPARTMENT-   Two fires in the Village of Maine was discussed.  Many departments were called during the simultaneous fires.  Who should respond and how many were needed were discussion items.


 


PLANNING COMMISSION-Map correction was recommended to the Town Board after the Public Hearing.


 


NEW BUSINESS- The Clerk received the termination letter from the City of Wausau for the Emergency Response contract.  The Clerk also received a new contract that needs to be approved by December 31st unless the Town has a different option.  The Town will discuss with SAFER and the Village of Maine if they will provide a different option.


The Clerk requested information and direction for the 2018 budget.  The Board said to consider the $100,000 levy limit increase which would be the same as last year.  The Board doesn’t want to make it an unending increase, but go through the exceeding the levy limit  process each year.  The Board doesn’t want to continue if we receive other funding to cover the Brokaw expenses.

Meeting called to order by Delmar Winter. Roll call was answered by Delmar, Wally and Andy.


Andy Walters moved to approve the minutes.  Second by Wally Borchardt and the motion carried.


Treasurer report was given by Treasurer Matsche.  Wally Borchardt moved to accept and file for audit.  Second by Andy Walters and carried.


CHAIR REPORT –Blacktopping of River Hills Road should be completed during the first part of September.  Last Thursday, road rating was completed for the WISLR/PACER program report. Stolze, Delmar and Rich reviewed end of N 81st Street area for a turn around for the Town plow truck.  This is the dead end area north of Rocky Ridge Road corner. Abraham will be hired to ditch by the cemetery on N 73rd Street.   Three culverts will be discussed to be replaced in 2018.  The town should apply with County on 50/50 cost.


SUPERVISOR REPORTS-Wally reported that the town employees continue to cut grass and brush along town roads.  A lot of time is spent grading gravel roads and River Hills Rd until blacktopped.   Andy said all of his time has been OSC and Brokaw related.


CLERK REPORT- nothing special


OLD BUSINESS-Andy reported on the OSC meeting and Brokaw.  The Administrator Gau will terminated.  Keith Rusch will be appointed Thursday to follow.  Rusch will get paid $30.00 per hour instead of Gau’s $60.00.  Rusch will be more hands on with the sanitary and well issues and may be a backup to Clayton.   Last week Senator Baldwin announced a 4.1 million grant to the Villages of Maine and Brokaw for water infrastructure piping, repairs, and new wells and piping.  The DNR accepted the water well changes and approval.  Lawsuit of City of Wausau on open meeting issue is trying to appeal.


Mathy Construction is trying to transfer property to Marathon County for the boat landing.  Marathon County had not


accepted due to environmental concerns.  The plan is to have a CSM for the boat landing with access to a public road.  Mathy will be logging and do not want traffic on their access road.  The residents of Brokaw hope to keep landing open.


Road equipment.  An old trailer that is not used was sold to Gohdes for $75.00  Kevin said it has no lights, and town hasn’t used for years.  Motion to sell by Wally.  Second by Andy and carried.


Website upgrade was tabled.


Loan from Board of Commissioner of Public Lands was discussed and tabled.


Time off process was reviewed.  Time cards and spreadsheet was reviewed for tracking of time off.


FIRE DEPARTMENT-   Milt talked about replacing turn out gear and potential cost.  Pietrowski may help with finding grants or some replacement help.


 


PLANNING COMMISSION-Map correction is needed for Granite Heights.  The area was missed as Residential during rewrite. 


 


NEW BUSINESS- Clerk noted the reduction of assessment due to the Village of Maine annexation was done between Kurt Moeller and the Department of Revenue.  Value reduced by $1,162,500.


Firework permit will be approved by Chair for John and Rocky Webb for September 16th.


Kevin Sann asked about gravel or granite delivery for town residents.  Delmar said tell people to contact local contractors or for very small amounts pick up at town hall.

Meeting called to order by Delmar Winter at 7:20 after Andy arrived from the OSC meeting.    Roll call was answered by Delmar, Wally and Andy.

Andy Walters moved to approve the minutes.  Second by Wally Borchardt and the motion carried.

Treasurer report was given by Treasurer Matsche.  Wally Borchardt moved to accept and file for audit.  Second by Andy Walters and carried.


CHAIR REPORT –Delmar reported that American Asphalt wanted to blacktop River Hills now in July.    Concerns were expressed by several town residents that not allowing enough time for compaction could cause large dips in the road.  Andy requested that we wait until September when American is in the area again to allow Kevin and Rich to work on the road more.  A question was asked about guard rail at the River Hills culvert location.  Chair said there are no guard rails in the Town, not even on North Troy.


Delmar said that Zach Rogers may be mowing the Town Park.


Delmar noted that Cattle Road ( north end of 81st Street) needs to be graveled and a turnaround is necessary for the Schefelbein property.


SUPERVISOR REPORTS-Andy noted that several meetings have been held in the last few months.  The meetings were Randy, Shane, Keith Rusch, and Andy and they could report back without a quorum.  They talked more with Kurt Muchow of Vierbicher.  Due to a previous resolution, we are required to pay 50% of the engineering and well costs.  The USDA grant is being backed by both Senator Johnson and Senator Baldwin which should reimburse much of the Vierbicher bills.  The State bill will pay back $583,000 per year for 5 years to help pay all of the expenses that the Village of Maine and Town of Texas have incurred under the state law.  This is not voted on yet and may not pass.  Clerk Bailey is being paid directly by the Village of Brokaw and should not impact the Town of Texas.  Wednesday will be a Special OSC meeting to discuss the OSC Administrator.  City of Wausau filed appeals against the Circuit Court decision.


CLERK REPORT- nothing special


OLD BUSINESS-Road work-blacktopping will need to wait until September.  Recycling Ordinance mostly follows the  DNR recommendation.  Website upgrade will be tabled until later.  County Treasurer letter noted processes that she is working on with Tax Delinquent properties in the Town of Texas.  There has been no progress on Adeline Krause in the past two years.


Delmar stated that he doesn’t think we need a loan from the Board of Commissioners of Public Lands, just a short term loan until we start to collect taxes for 2017.


Road Names were reviewed.  Motion by Delmar Winter to approve names as presented.  Second by Wally Borchardt and carried.  Note that Anderson Road and Autumn Brook Terrace were not on the map, but are not being changed.


FIRE DEPARTMENT-   Milton noted that Turnout gear, air packs etc are all about the same age from after 9-11.  Most life expectancy considered replacement by 2018-2019.  Fire Department should apply for grants.  Raffle Fund raiser should help some. 


PLANNING COMMISSION-No quorum no meeting 


NEW BUSINESS- The new Assessor contract was received by the Clerk.  It was presented to the board and Kurt Moeller will be the assessor with Carl his father assisting as necessary.  Motion to approve by Delmar Winter.  Second by Wally Borchardt and carried.


NCWRP Resolution was presented.  Motion to accept by Andy Walters, second by Wally Borchardt and carried.  This was necessary for the grant application being worked on by North Central Regional Planning.

Wally Borchardt moved to approve the minutes in the consent agenda.  Second by Delmar Winter and carried.


Treasurer report was given by Treasurer Matsche.  Delmar Winter moved to accept and file for audit.  Second by Wally Borchardt and carried.


CHAIR REPORT –Diggers hotline need to mark on River Hills Road next week.  Ullenbrauck wants a shop culvert at T5072 River Hills Road.  Position and size need to be reviewed.  Address sign for T661 Marshall Hill Road needs to get placed.


CLERK REPORT- Report that the Board of Review was held and all sales and changes were reviewed with both Carl and Kurt Moeller.


OLD BUSINESS-American Asphalt bid was opened and was the only bid.  $119,952.16 was the total bid.  Pulverize $6000, $2500 shape and roll, $111,415.00 fine grade compact and 3” blacktop compacted to 2 ½”.  Road base and shouldering will be done by Town.  Wally Borchardt moved to accept the bid.  Delmar Winter seconded the bid and it carried.  Timing depends on plant-the plant will be close mid July, then in mid September.  Kevin recommended to wait until September.


Asphalt roller and trailer in back of town hall hasn’t been used for many years.  It does start but doesn’t run well.  Daryl Gohdes had contacted the town for purchase.  Daryl put in a bid for $250.00.  Motion by Delmar Winter to accept.  Second by Wally Borchardt and carried.


OSC was discussed.  Village of Maine wants the size of the Brokaw board reduced since they are only reviewing and the commission has complete overview of any payments and action of the Village of Brokaw board.


Kevin reviewed road issues and may need tires on the mower.  Some minor washouts by roads happened with the last storm.


Village of Maine clerk wages were discussed since the town has not approved the OSC motion.  Town of Texas clerk would like electronic copies of the OSC minutes.  There have been discussions about separation of duties within the Village of Brokaw duties since Clerk Bailey currently is receiving moneys, doing checks, and balancing accounts.


Recycling ordinance was tabled.


Website changes were tabled.


Delmar reported on junk car issues.  No letters will be sent by attorney yet.


Discussion on budget and loan from the Board of Commissioners of Public Land was tabled.


Liquor Licenses for Trapp River Golf Club (Texas Recreational Center), BK Corners and Wausau Skeet and Trap were conditionally approved if all paperwork is completed and submitted to the clerk.  Motion by Delmar Winter and seconded by Wally Borchardt.


FIRE DEPARTMENT-   No Report. 


PLANNING COMMISSION-Planning Commission recommended that the Town Board request information on the tax deed process for three properties.  T13063 and T13065 County Road W (Wasmundt) and T701 Marshall Hill Road ( Adeline Krause)  Motion by Delmar Winter, second by Wally Borchardt to request information and it carried. 


NEW BUSINESS- Discussion on paying Linda Graykowski for upkeep at the Town Park.  Motion by Delmar Winter, second by Wally Borchardt to pay Linda $50 per month for 6 months each year for her work.


Wally discussed mowing at the park.  Past years Kevin Paul Sann had been paid $10.00/ hour.  Wally recommended his grandson Kyle Borchardt.  Kevin Sann said he would train him.

Andy Walters made a motion to move the minutes out of the consent agenda. Delmar seconded the motion and it carried.  Andy corrected the minutes that reported Janet Sann was appointed to the Planning Commission to replace Delmar and should have read replace Andy Walters.  Andy made a motion to approve the minutes with the correction.  Second by Wally and carried.f


Treasurer report was given by Treasurer Matsche.  Wally Borchardt moved to accept and file for audit.  Second by Andy and carried.


CHAIR REPORT –Delmar reported talking with Russ Graveen of Marathon County Highway Department about culverts, he will try to include River Hills culverts in the county culvert replacement program this year.  Culverts could be 60”, they are oversized currently.  These are the culverts just east of N 57th Street on River Hills Road.  Estimate for culverts, back hoe, rip rap and use of our trucks about $10,800 County would pay 50%.  DNR report should be back by May 9th.


SUPERVISOR REPORT- Wally reported problems at Jesse Field.  People are dumping junk and waste by boat landing and trestle.  Discussion on whether large rocks in trails would reduce problem.  There are trails for river access so that may not solve the issue.  Also, people would probably just dump by rocks.


Andy’s report Dog license issue is over, but when all town officials are notified by email, who should respond?    Also, Andy noted that John Webb wants 73rd Street to be Buffalo Ridge Road and that is currently on the road list at the county.  Some discussion on other road names.


CLERK REPORT- Noted the following information received: Salt Solutions, WISLR to be completed by December 15th, Meverdens prices for this year.


OLD BUSINESS-Discussion on Vierbicher bills and whether the Town of Texas should be paying for well searching, test drilling, etc.  Grants should cover most of the costs, but this is not just maintenance of the Brokaw systems, but rather infrastructure.  USDA grant should cover 75% of the 3.95 million.  Andy reported that he met with Shane the Town Attorney to get up to speed on all issues as the new Texas Representative on the Over Site Commission.   Delmar Winter made a motion to hold Vierbicher bills until Andy discusses well search, siting etc on bills and what part the Town of Texas should be paying.  Second by Wally and carried.


Matt tried to get funding from County to cover the City Lawsuit, but probably will not happen.  Out attorney costs were about $25,000.


Andy also discussed Clerk Bailey’s bill to Brokaw and how much per hour had been approved.  Town of Texas only approved $20.00 per hour but bills are coming in at $30.00 and have been approved by the Over Site Committee. 


Town Website was discussed.  Andy doesn’t think that it works well.  Andy thinks more information should be on the site.  Such as the Code of Ordinance.


 

The Planning Commission has 5 issues on list to be notified of junk issues.  The Board wants to talk to the land owners first for compliance. Prior to Attorney sending letters.  Another added to list by Board is Jarntowski.


 

FIRE DEPARTMENT-   No Report.  Delmar noted that there will be a joint training with Pine River, Hewitt, and the Town of Wausau.


 

PLANNING COMMISSION-Planning Commission has 5 issues on list.  Two are not junk cars, Macomber, and Krueger. 


 

NEW BUSINESS- River Hills Road project was discussed.  Clerk was told to publish for blacktop bids 1 mile more or less, 22 foot wide, 3” mat compacted to 2 ½” Pulverize current road bids needed to be included.  Alternative to completing the road would be to replace culverts only.

Meeting called to order by Matt Bootz.    Roll call was answered by Wally, Delmar and Matt.

Consent agenda (minutes)was reviewed and approved by motion of Delmar Winter and second by Wally Borchardt and carried.  Treasurer report was given by Treasurer Matsche.  Wally Borchardt moved to accept and file for audit.  Second by Delmar and carried.

CHAIR REPORT –Will pull weight limits for roads when county does.

SUPERVISOR REPORT- Lee Webster area of Pine Bluff Road culvert is sinking and the bottom is rusted.  Town Road crew added gravel to edges to extend lifer.  Should consider replacement through the County Culvert program. 

Wally reported that someone is interested in the old green roller and would give junk price for it.  It ran about 2 years ago. Matt said should be bid out if we sell.

CLERK REPORT- No separate report

OLD BUSINESS-Clerk still has issues with what should be paid to the Maine Clerk for accounting, minutes, and agendas.

Delmar discussed potential project for 2017 being River Hills Road from N57th to N 73rd Street.  Should it be ground and resurfaced or wedged and chip seal.  Two culverts near N 57th St to River need to be discussed and fixed or replaced before road is repaired.  Delmar will contact the county.  More discussion needed.

Report on address changes.  Towns Association says that the county can’t force towns to pay for the signs and road signs.  The county would have to pick up all costs.  The county will have more discussions on costs and charges.

FIRE DEPARTMENT-   Fire Chief Rick Walters submitted bills to be paid.

 

PLANNING COMMISSION-Complaints on Adeline Krause property- County needs to take by Tax Deed.  Matt will contact County Treasurer-Audrey Jensen for update on process.

Virgil Kasys property at T5328 County Road W has action with people coming and going.  Junk cars are a concern also. 

 

NEW BUSINESS- Oversite Committee   Next meeting is May 4th at 7pm Village of Brokaw hall.

Village of Maine Clerk is requesting $30 per hour.  Originally discussed $20.  Delmar moved to remain as original of $20 per hour for accounting function.  Second by Matt Bootz and carried.

 

Amendments to the Town Zoning Ordinance as recommended by the Planning Commission were pasted by a motion of Delmar Winter.  Second by Wally Borchardt and carried.

 

Appointment to fill Delmar’s vacancy on the Commission was filled by Janet Sann.  Motion by Matt Bootz and second by Delmar Winter and carried.

 

Delmar Winter moved to have Attorney Vanderwall update our Garbage and Recycling Ordinance to comply with DNR rules.  Second by Wally Borchardt and carried.

 

Website upgrade was requested to add to next month agenda.  Delmar suggested that Tamara could produce a new website.

 

Resolution was presented by the Treasurer to have Delmar update signature cards with River Valley our bank and reaffirm that River Valley is the depository for the Town of Texas.

Meeting called to order by Delmar Winter    Roll call was answered by Wally, and Delmar   Matt did come later after his daughter’s birthday party.


Consent agenda (minutes)was reviewed and approved by motion of Walter Borchardt and second by Delmar Winter and carried.  Treasurer report was given by Treasurer Matsche.  Delmar Winter moved to accept and file for audit.  Second by Wally and carried.  Paul Anderson requested a monthly listing of Brokaw expenses.  The Clerk will need to make the list.


CHAIR REPORT –Tabled for Matt. Matt said all of the items are on the agenda separately.


SUPERVISOR REPORT-   All equipment looks good.  Wally said the employee refrigerator needs to be replaced.  Delmar said he drove the town roads and thinks the River Hills  Road is the worst.


CLERK REPORT- Noted dates for Open Book and Board of Review as June 1st 5-7 open book and 7-9 Board of Review.  Also noted Annual County Highway letter, and Annual letter from CPZ questioning road work for this summer in hopes of preserving monuments of quarter sections etc.   Clerk also noted that the street names had been submitted to the County.  There will be a few more changes yet.


OLD BUSINESS-Not any additional reports


FIRE DEPARTMENT-   Fire Chief Rick Walters submitted bills to be paid including those for Annual Dinner.  He also noted that we are entering Grass Fire Season—be careful.


PLANNING COMMISSION- Commission recommended proposed amendments and set a hearing date of April 3rd prior to the regular Planning Commission meeting. 


NEW BUSINESS- Oversite Committee  appointment tabled for Matt to attend.  When Matt arrived, he recommended that Andrew Walters be appointed since he has Engineering, and soil background.  Paul Anderson said he would recommend Andy also with his knowledge and background.  Janet Sann said that Andy not only has knowledge but says exactly what he believes is best for the Town of Texas. Delmar said he would like Andy to get all information from the OSC Committee.  Matt said the decision on the appointment is up to the new Town Board after the April Election.


 Harters had called Matt about the Disposal Contract and bidding.  He would not be able to beat our current contract.   We currently pay IROW for trucking and pickup and Marathon County Solid Waste for disposal at the Land Fill.  Delmar Winter moved to extend our current contract with IROW for one year per current contract.  Second by Walter Borchardt and carried.  Matt abstained due to personal reasons.


The Annual Highway letter is the order for next winter salt  and other cost sharing.  Delmar moved to apply for 100 tons of salt like years in the past.  Wally Seconded the motion and it carried.


 Matt said Shane is working on letters to the land owners with too many vehicles.


 Uniform Addressing will happen in the next couple of years.  Any questions or comments can be shared with the Marathon County CPZ office.


 Reviewed Annual Town Report and will add the 2014-March 2017 costs of Brokaw.


 Matt noted that Janet Sann would be interested in being appointed to the Planning Commission.  Appointments will need to be done after the election at the April meeting on the 10th.

SUPERVISOR REPORT-   All equipment looks good.


CLERK REPORT- Assessor notified of the Initial Attachment Area


OLD BUSINESS-CBA report:  Delmar made a motion to accept the $20,000 reimbursement from the Village of Maine to equate the fact the Texas paid the requested amount to Brokaw of $40,000 and Maine did not.  Village of Maine Clerk to do the accounting function of the Village of Brokaw.  Frojker will be the only attorney for the OSC and the Village of Maine will pay his bill.  Shane may be required at times.  March 2nd Next OSC meeting at the Town of Texas at 6:30 pm.


FIRE DEPARTMENT-   Delmar reported that bills for the fire department will be mailed to the Fire Chief and not the Town Clerk.  The bills will be forwarded to the clerk for payment.  Delmar said that the clerk had to pay Pomasl $236.00 for a helmet, but Rick would give the clerk documentation later.  The clerk questioned how well this will work, Paul Anderson stated it will be better for the Fire Department to keep tract of purchases and payments.  Clerk reminded that the 2% dues report needed to be filed.


 


PLANNING COMMISSION- Commission recommended to Town Board that certified letters be sent to parcels that have had complaints of too many cars, or junk vehicles.  These were Cleveland, Zemke, Krueger, and Macomber. Request cleanup by mid-April.


 


NEW BUSINESS- Delmar made a motion to have the TownBoard and Planning Commission assign new road names for those the County require new names for.  Second by Wally and carried.


 


Matt made a motion to send certified letters toyah the three that have been contacted before and that he would contact Macomber in person for the initial contact.  Second by Delmar Winter and carried.


Matt reported that the vouchers from 2016 were reviewed with no errors.


Matt will check on fees for rezoning parcels.

OLD BUSINESS-Russell Schreiber discussed logging on town property off of Wisconsin River Road.  Wally moved to have a contract with Schreiber for the logging.  Second by Delmar Winter and carried.  Probably not getting done until next year depending on pricing.

PLANNING COMMISSION- Nothing Special


NEW BUSINESS- Names were drawn for placement on April Ballot.  Supervisor Andrew Walters first, Wally Borchardt second.  For Clerk Lorraine first and Melissa Raddatz second.


February 13th meeting will begin at 6 pm with Audit of Town Records with Regular Meeting at 7 PM.  Completion of audit after Board Meeting if necessary.


Philip Walters complained about Town Line Road.  The Slush should have been removed before it froze and left heavy ice ruts.

Town of Texas Town Board Meeting

November 14th, 2016

Meeting was called to order by Supervisor  Walter Borchardt.   Roll call was answered by Wally, and Delmar

Clerk questioned building permit for $40.  Treasurer said the other $5.00 had just been received.


CHAIR REPORT –No report


SUPERVISOR REPORT-  Wally reported that the grader tires will not make it through the winter.  Cracks on some.


CLERK REPORT- No special report


OLD BUSINESS-The ATVUTV ordinance was adopted and roads were reviewed and corrected by Delmar.  Clerk had Granite Road from 49th and should be from 57th. Second by Walter Borchardt and carried. 


A meeting was set for November 29th at 7 to set salary and car use for next term from April 2017-April of 2019.


A  Budget hearing was set for December 12, 2016  a t 7 PM and the Special Town Meeting after to set the levy for 2016.  A postcard with the information would be sent by the Clerk. Motion to send by Delmar Winter.  Second by Walter Borchardt  and carried.


Delmar Winter moved to adopt the resolution to approve increasing the tax levy by 30.07 % or $100,000 for the tax levy year of 2016 to be collected in 2017.  Second by Walter  Borchardt and carried.


The Resolution of Intent to Bond was reviewed.  The well etc would need to be paid for and then get grant money.   Matt will check on this Resolution since the new wells would not be a town obligation but the Village of Maine.


The Town Chair arrived late and discussed the need.  for an administrator for the  Oversite Committee and possibly remain with the Village of Maine.  Cost would be about $50,000 to $62,000/ year and divided between Town of Texas and Village of Maine.  The Administrator would be part time and work to get grants.


Matt stated that he would be available after April as the County Board Supervisor after his term of Town Chairman ends.

NEW BUSINESS- Philip Walters was vocal on whether his sons and farm need to pay for the 3 culverts off of Cain Creek Road or the town should pay. Matt said done and he would talk to Philip after the meeting.


 


Town board with town employees will look for grader tires and replacement costs.

CHAIR REPORT –Matt reported that the  City of Wausau had filed a suit against the Wisconsin Department of Administration over the approval of the Cooperative Boundary Agreement.


SUPERVISOR REPORT- Delmar reported that the new county wide addressing will be postpone until 2018.  Wally reported that the grader tires are in poor condition and need to be reviewed for replacement.


CLERK REPORT- No special report


OLD BUSINESS-The culvert policy needed more discussion.  Ray as Zoning Inspector should not make the decision.  The Town Board should make the decision.  A check off on the zoning permit application should be added and used to confirm or deny the need for a culvert.


The ATVUTV ordinance needs to be adopted with names of roads that are open to use.  Delmar also reported that the Town of Wausau may be interested in opening N 33rd Street and Granite Road.


Direction to clerk on the 2017 budget. Various discussion on road needs.  Kevin thinks Fawn Road should be wedged and chip sealed. Delmar thinks that we can postponed doing some roads because they still have life although not in the best condition.  The Board will hold another meeting to review road needs.


FIRE DEPARTMENT- A new light was purchased to light fire sites.  The funding should come out of the Brokaw Credit Union Fire Department account.


PLANNING COMMISSION- Very short meeting, some permits.   Don Hildebrandt questioned what is happening at T5328 County Road W.  There are various autos in various conditions coming and going on the property.



NEW BUSINESS-Matt read on the agenda about nomination papers.  Matt stated that he would be signing a NON Declaration of Candidacy document.  He will not run for another term.

CHAIR REPORT –No report


SUPERVISOR REPORT- Tractor still has issues and the culvert is still an issue.  Wally questioned digging east of Cell4 and what is happening.  Delmar had an issue with Charlie Baumann and garbage pickup but worked with IROW to correct.


CLERK REPORT- Change in in-person-voting.  Now when clerk has ballots  voting can take place through November 6th at 5 pm by appointment. For the last couple of years, in person voting was limited to 2 weeks, work days only and not after 7 pm.  This was restrictive to part time clerks that had full time jobs. Notice was received that the  DOA approved the CBA.


 


OLD BUSINESS-The Culvert issue for Gille on Castle Rock was discussed.  The contractor Gaffney Construction had a list of days and times that they had contacted Ray Rogers about the culvert issue or whether one was required.   He had told them one was not required, but the Town Board had one delivered.   The culvert was not installed and then was pushed to edge of lot and disappeared.  The water doesn’t go on the Town Road, but does travel across the driveway.  The Board said no culvert is needed now, but they will wait to see what happens.  The Board also said that the culvert would need to be paid for.  Clerk to bill $175.54 for the culvert. ATVUTV issue was discussed further.  Delmar called Marathon County Highway Commissioner about some county road opening.  He said that the County may considered if opening would connect Routes to Routes.  Somebody would need to cover liability for the County if they open any portions of County Roads.  JD Parker would like to talk to Town Board about routes.  He works with Lincoln County.  Delmar also talked with Wausau Chair Jim Riehle about 33rd St, Granite and 57th.  It was brought up at Town of Wausau Meeting but no decision.  Paul Anderson questioned about individual insurance if operating on roads.  Paul also said everyone should go by state rules including registration, Plates, helmets, and ATV safety for youth with parents.


An Ordinance still needs to be adopted including process of opening roads.


Wally talked with Matt about seal coating next year, and wedging   Kevin thought about $20,000 this year and $25,000 next year.    The budget will need to be discussed at October meeting.


FIRE DEPARTMENT- Delmar discussed bids for new turn out gear.  $2,200 per set.  Will try to purchase three sets per year, starting with the volunteers that show up the most or how old the suits are.


PLANNING COMMISSION- Very short meeting, some permits.  Recommendation to require Gille to pay for lost culvert.


NEW BUSINESS-Clerk requested direction for the 2017 budget.  None was given, will discuss more in October.

CHAIR REPORT –No report

SUPERVISOR REPORT- Tractor was sent back to shop.  It was put together wrong during repair.  Also noted tree issues with storm last Thursday.

 OLD BUSINESS-Brokaw issue tabled until Matt can give report.

Road work report-North Troy aggregate was swept and removed by Scott Construction.  Wild Rose needs grading after fire issue.  Maintenance on tractor again as reported by Supervisor.

Loan tabled until later and more obvious need.

Signs were purchased for ATV/UTV roads.  Costs will be reimbursed by requesters. Shane needs to write or edit ATV/UTV ordinance so we have a working document.  Put on next month agenda.

Split Rock Lane blacktop as requested by Jerry Kittel and residents will not be done due to shortage of dollars due to the Brokaw costs.  Issue may be revisited in future.

A culvert was delivered to the Gille property on Castle Rock for installation.  It was not placed in the driveway and disappeared from the lot.  Water washes across blacktop driveway.  Ray Rogers, Zoning Inspector said it was not needed on the property that the property is at the top of hill and no ditch or culvert is necessary.  The clerk was told to bill the property owner for the culvert that disappeared.  Philip asked who is responsible to determine culvert need and placement.  Is it the Town Supervisors or Zoning Inspector.  Wally will review the area after any heavy rain and will discuss again next month.

FIRE DEPARTMENT-Bill will reduce payment to Alison from Retirement payment to cover education cost per agreement.  Fire Department policy is that any Volunteer needs to request training from the Fire Chief and receive approval prior to training if Town will reimburse costs. If education is done on own without previous request, the Town will not necessarily reimburse the volunteer.  This policy should prevent the issue with Alison and Sadie. 

No raffle will be done this year without a town picnic.

SUPERVISOR REPORT- Maps were shown and reviewed for the CBA after the State DOA requested more properties be annexed to Maine.  The maps were drawn by Town Board on July 5th at a special Board Meeting to respond to DOA’s issues.  Don Hildebrandt requested a special meeting for the Panhandle residents.  Meeting set for Monday July 25th at 7PM.  Clerk to send postcards to Town property owners.  Delmar reported on Addressing Meetings.  Don Hildebrandt wanted record to show that he said don’t give up any ordinance or rights or liberties for town property owners, or residents.

CLERK REPORT- No special report.

 

OLD BUSINESS- Scott Construction did sweep North Troy St to remove excess aggregate.

Ron Stroik said ABJ shouldering looks nice.

Mower Tractor warrant was discussed.  Delmar Winter moved to approve $3765 for a three year warranty.  Second by Wally and carried.

Commissioner of Public Lands loan was tabled until Chair is in attendance and budget is reviewed.

ATV/UTV ordinance and paperwork was discussed.  No action.

FIRE DEPARTMENT- Bill reported that he will hold the funds from Alison’s share of retirement to cover costs that were paid under her agreement.

 

PLANNING COMMISSION- Issue with Kutil and Attorney Deffner was discussed and permits reviewed.

CHAIR REPORT – Planning Commission agenda needs to review zoning of Forest Hill Road off of N Troy St.


Problems with the grader.  Board needs information on cost to fix or the lease one.


Special Hearing is set for June 27th by the WI Dept of Admininstration on the Cooperative Boundary Agreement because of request of a property owner.


SUPERVISOR REPORT- Reports on extended warranty on tractor for mowing.  The tractor is having some issues and a partial for the warranty could be purchased.  The town employees and supervisors will check into the cost and value to make a decision.


Kevin has had some health issues and missed some work.  Rich had Dan Koehler and Roger Rhyner help some.


Delmar noted that the county has a new form for addresses.  Delmar will work with Preston at the County for a new address on Buck Trail Road.


Gayle Koehler called about a dog that looks sick and isn’t being taken care of


CLERK REPORT- No special report.



OLD BUSINESS- County Address Committee report from Delmar.  Duplicate road names will be listed and sent out.  Towns will need to review for needed changes.  Hope is to migrate to new address system in 2017. 


No report on Brokaw due to hearing on June 27th.


Gene from Scott Construction will have then end of N Troy St swept of the excess aggregate.


Bids that were received last month were reviewed.  Matt moved to accept the bid for grinding and blacktopping by American Asphalt and shouldering by ABJ.  Second by Wally and carried.


Delmar noted signs were purchased for ATV/UTV roads.  Costs will be reimbursed by requesters.


FIRE DEPARTMENT-Bill will work with Alison on reimbursing the Town for education per her agreement.


Bill state new fire gear is a need for the department.  He recommended purchasing 3 suits per year.  Each suit is about $2500.  There are 10 active fire department members that need to new suits the most.


 


PLANNING COMMISSION- Very short meeting, nothing special to report.


 


NEW BUSINESS-Russell Schreiber suggested that the second part of the Town land on WI River Road should be logged.  It is about 25 acres for about $10,000.  Depends on grade and yield.  It would not be clear cut some trees would be left.


Liquor licenses applications were discussed.  Motion to approve Texas Recreation Center, BK Corners and Wausau Skeet and Trap Club after all paperwork and publications are completed and turned into clerk.  Motion by Matt Bootz, and second by Wally Borchardt.


 

Clerk will work on survey for the WTA.


Delmar talked about getting onto farm land on the crest of a hill without a culvert.  He will check with town employees about access.

CHAIR REPORT – none


SUPERVISOR REPORT- Reports of some wash outs on County Line Road  due excessive rainfall.


CLERK REPORT- Reported that the form for 100 tons of salt was sent to the county highway dept.


 


OLD BUSINESS- Cooperative Boundary Agreement is in limbo until the WI Dept of Admin holds a hearing due to a complaint filed with the department.


Resolution for Cost Sharing with the Village of Maine was reviewed.  Matt made a motion to approve.  There was no second and no action.  Matt said he is hoping that the County will give $20,000 for litigation costs.


Road maintenance issues-Anderson Road, and  25th Street have washouts not listed by Superivsors.


Open bids for pulverizing, blacktopping, and shouldering were opened.


ABJ will charge $16.25 for base on shoulders.


RC Pavers bid was $163,028.04 for pulverizing, fine grading, water and compact base, pave with DOT spec hot mix and shoulder new asphalt.


American Asphalt- $6090 for pulverizing, blacktopping $124171.40, and shouldering $11,124 or total of $141,385.40.


Matt suggested that he and the clerk needed to review the Town Budget before a decision was made.  No action was taken.  To be put on June Agenda.


The ATV/UTV ordinance requires signature of ¾ residents on the road way.  Signs will be ordered by Delmar.  Costs will be reimbursed by person that circulated the request and submitted signatures. No map will be made of roads open, only the signs will designate those roads.


FIRE DEPARTMENT-Bill noted that the department audit was finished and they are waiting for the report.  Alison Baker resigned from the department.  She had the original agreement to reimburse the town if she didn’t remain active on the department.


 


 PLANNING COMMISSION- Very short meeting, nothing special to report.


 


NEW BUSINESS-Nancy Borchardt of the 50/50 Homemaker Club reported that they had received a $250 matching funds grant from Thrivent but asked the Town for $600 to use for shrubs and flowers at Jesse Field and Town Park.  The landscaping and sign needed to be replaced and cleaned up with new plantings. Motion by Matt Bootz, second by Wally Borchardt to approve the request.


 


Kevin is checking into the tractor warranty.  The salesman said they would work with the town on the problem.


 


Adeline Krause property was sold and is listed on Craig’s list as a fixer upper.  The property is on the corner of Marshall Hill Road and County Road W.  The lot is nonconforming and the structure is in bad shape.  There are questions on the vision triangle also.  The Town will need to keep an eye on the property.

Treasurer report was reviewed.  Motion by Delmar Winter to accept and file for audit.  Second by Walter Borchardt and carried.  Delmar questioned Marian on the item $716.19 listed as RV expenses-Feb correction no bank statement.  Detail to be provided in May.

CHAIR REPORT – Matt appointed Delmar Winter to be the Representative of the Town of Texas for the County Address System changes.  Matt noted CBA changes and discussed them with residents in attendance.


SUPERVISOR REPORT- Wild Rose needs grading.  Discussion of North Troy chip seal problems will be in Old Business.

CLERK REPORT-Nothing special


OLD BUSINESS- Discussion on the Cooperative Boundary Agreement and resolution to accept the CBA.  Matt Bootz moved to approve the Resolution to accept the CBA subject to modifications.  However in no event shall the agreement exceed 17 years in sections 5.1 and 11.4.  Second by Delmar Winter.  Roll Call vote unanimous approval by Delmar, Wally, and Matt.


Road Maintenance on North Troy discussed.  Dan Louma wants minutes to reflect his concern for safety because of the excess aggregate left on road that did not adhere during the process. Board members will look for sweeping the excess on the north end of North Troy.  Lack of traffic on the dead end didn’t allow for the aggregate to adhere as good as the rest of the roadway.


Discussion on the aggregate used and what other towns are using.  The Board may create a policy on what material to use with the seal coat process.  A meeting was scheduled for 6:30 pm on the 19th to discuss potential sweeping or plan for the removal of excess.


The Dog Kennel issue was eliminated with the sale of the property to another individual.  However, Matt stated that the Planning Commission has to have clarity for votes of aye or nay and needs reasons for votes.  This was a learning process.  Motion to deny by Matt, second by Wally and carried to close the issue.


Motion by Matt Bootz to submit request to Marathon County for 100 tons of salt for the 2016-2017 season.  Wally seconded the motion and it carried.


Bids for grinding, blacktopping and shouldering tabled until May.  The Daily Herald did not print the Notice and did not respond to the Clerk’s email as to reason they failed to print.


The ATV/UTV ordinance was discussed.  It should be ¾ of residents need to sign as approved.  Petitioner needs to get signs and be responsible for cost and the posting of them.  Matt suggested one elected official should supervise the placement of signs and posts.  Delmar will talk to DNR and Shane about approving roads.  Matt will talk to Sheriff.


FIRE DEPARTMENT-Bill noted that inspections have been completed on Commercial properties and the equipment repairs have been completed by Keith Plautz.


 PLANNING COMMISSION- Cleveland had additional cars brought to his property on a flat bed trailer on posted roads.  Building permits may have expired.  He was supposed to build and put vehicles in shed.  Wally and Ray to talk with him on the issues.

Consent agenda was reviewed.  Motion to approve by Delmar Winter, second by Wally Borchardt and carried. The Planning Commission was invited to attend and roll call was taken. 


The meeting began as a combined meeting with the Planning Commission to get their thoughts, questions, and recommendations on the Cooperative Boundary Agreement.


Because there had been opposition to the original initial attachment area, the new proposed area would let most of the residents to remain in the Town of Texas and not be annexed to the Town of Maine.


Part of the City opposition to the Plan is that it doesn’t meet the Comprehensive Plan.  The Board and Commission both realize that, but at the time of the Plan no one would have guessed that Wausau Papers would close the mill in Brokaw and cause the debt issues to be spread to the Towns.


The Cooperative Agreement hopes to protect the tax base of the Towns which will take on the debt of Brokaw through the agreement. 


A vote was taken on whether to accept the new initial area or the original or none.

Philip is concerned that Town Government is so important and that larger governments loose local control.

Members had issues with the 17 years that is way too long.


Jim Burgener said that we live in a republic where we elect people to represent us with the best interest of all municipalies combined.  This may not be the best but currently is the best alternative.

Andy was concerned with the language of maintenance since just maintenance of a system can be very expensive.


With the 3 member commission, we will have some control but without it we have no control on Brokaw expenses.


Paul Daigle suggested that Texas propose 5 years up to 10 years depending on circumstances and not 17.


According to the agreement, we would not have to help with capital expenses, but maintenance.

OLD BUSINESS- The Annual Highway letter from Marathon County was received.  Do we order salt or anything this year.  Kevin wanted to know if we can order from Lincoln County instead.  He will talk to Lincoln County.  Otherwise, we would order the same as last year from Marathon County.


Motion by Matt Bootz, second by Delmar Winter to move banking from Peoples to River Valley due to potential litigation with Peoples.  Motion carried.

Discussion on replacing any signs until the County confirms the new address system.


Email addresses should be added to the Annual Report.


FIRE DEPARTMENT-The department will have Keith Plautz inspect and do maintenance on the fire trucks.  Motion to approve by Delmar, second by Wally and carried.


 

 PLANNING COMMISSION-A discussion was held on readdressing of Marathon County and the Brokaw issue.  Lorraine said she could approve the new proposal after several people from the south part of town said that the water and sewer are not the issue, but they would like to remain part of the Town of Texas.



NEW BUSINESS-The Clerk should proceed with the Daily Herald for publication on grinding, blacktopping and shouldering of N 69th Street, and Quarry Road.  The bid request should be for each process and for each section.

CHAIR REPORT-Castle Rock has issues with road damage, too many cars on a lot, and the steep road has issues in bad weather.  Brokaw will be discussed later on agenda.

 SUPERVISOR REPORT-Wally reported problems with dumpsters in poor condition.  The dumpsters are owned by IROW, any issues need to be done by the company. 

CLERK REPORT-  Eastern Towns agenda noticed, IROW rate increase per contract, Bridge Inspection on County Line Road given to board.  They will give to town employees.

OLD BUSINESS-A rough draft for the Cooperative Boundary Agreement will be reviewed by Attorneys this coming week.  A Public Hearing has been set for February 10th    ,location to be announced.  The engineering study will be part of the draft plan.  Matt said that Brokaw would not be annexed until all grant opportunities would be depleted.  Philip Walters asked about the Engineering firm and is there is a list of their scope of study.  Matt said the Request for Proposals listed the “scope of work”.

Fee schedule was reviewed.  Weed cutting will be removed and Brush Hog use inserted at $80.00 per hour.  Motion by Matt Bootz, second by Wally Borchardt and carried.

Road work-nothing to discuss at this time.

FIRE DEPARTMENT-Appreciation Dinner is scheduled for first Saturday in February.  Members will get new T-Shirts.  Kevin Sann and Fire Department members looking at costs for repairing the cement and grates in both areas.  Donations to the fire department should be transferred to the Brokaw Credit Union account for fire department.  These funds can be used by Fire Department.

PLANNING COMMISSION-Members asked about copies of the building permit fees.  They discussed double fees without permits. More discussions at next meetings.  Matt and Ray will work on issues with building without permits and a couple of non-compliant properties currently.

 SUPERVISOR REPORT-Wally reported not many roads were flooded with the excessive rain. 

CLERK REPORT- Overland Transportation random selection needs a drug test scheduled for Kevin Sann.  Wally will work with him to get it done.

OLD BUSINESS-Paser program was submitted by clerk.  We need a three year road plan, but will wait for the Brokaw Issue to get settled.

Vote in Maine created the Village.  The current board will run the Village until the April Elections.  Maine, Brokaw,  and Texas will meet with the engineers next Monday and have more talks on the Cooperative Agreement.

The Duginske issue with dumping was discussed between him and the Constable.  There are no Dumping Signs, but not adhered to.  Clerk will get a map copy of the area.

Clerk to contact County Finance Director for interest paid by Village of Brokaw to Peoples State Bank on TIF loans.  Maine and Texas will meet with Peoples Bank again.

Rural Tanker was discussed.  Delmar will talk to Schlei and Riehle at Eastern Towns meeting in January.  He will get tire prices, since they haven’t been replaced for about 20 years and should be every 7 years.

Split Rock Lane request reviewed.  Even 40-50 feet is expensive.  Matt doesn’t see any gravel roads being blacktopped in near future.  We need to maintain current blacktop.

Every two years, election officials need to be appointed.

The first extra half hour was designated as informational discussion on the Brokaw Issue and the Cooperative Agreement with Brokaw and Maine.  Many questions related to the Evergreen Road area that may be annexed to Maine if Maine votes to incorporate into a Village.   Maps and hearings would be held after the vote on December 8th to plan next steps.

CHAIR REPORT-Chair reported on issue with culvert on Steel Lane.  Kevin Sann will talk with Abraham about project.  Matt had contacted Gene Murray from Scott Construction about excess aggregate on N Troy St.  He will review the issue.

 SUPERVISOR REPORT-Delmar reported that he approved Kevin Sann to use the Town tractor for brushing on snowmobile trails in town.  Sann will provide town with amount to bill the club.

Delmar reported that the Rural Tanker Association is considering disbanding, selling tanker and dividing proceeds.  Milt says the tanker is an asset to Texas because it is faster than other town’s responses.

CLERK REPORT-Michael Duginske had called her.  He has an issue with dumping behind his house on the railroad and Public Service property.  Constable Stan will work with Duginske’s issue.

OLD BUSINESS-Paser program and rating of roads need to be entered into state system by clerk.

Matt said that he talked with Attorney Shane about budget needs.  Matt said the town board will not do a resolution to exceed the levy limit for 2015 tax roll.  If funds are needed, the town can take out a loan and do a resolution for 2016 tax roll  to exceed the levy limit to cover costs associated with Brokaw Issue.

Budget Meeting and hearing set for December 3rd at 7 pm.

A meeting will need to be set to review vision triangles.

The Resolution to Authorize Borrowing to the Village of Brokaw was read to the attendees.  The Town of Texas would borrow $31000 to Brokaw for them to meet obligations in 2015.  Motion to approve by Matt Bootz, second by Wally Borchardt.  Motion carried by voice vote all three ayes and no nays.

Split Rock Lane was discussed.  Kittel said that at least the approach to County Road W should be blacktopped.  The grader operator is at risk on County Road W when turning around.  Board will review more and look at cost.  Matt will talk to County Griesbach about the issue.

CHAIR REPORT-Chair reported that on October 5th the Board passed a resolution to work on a Cooperative Agreement with the Village of Brokaw and Town of Maine and that the Town would pay their Attorney and share in some other expenses in the negotiation process.  Matt and Attorney Shane have been corresponding on issues.

OLD BUSINESS-Paser program and rating of roads set for October 19th .  Split Rock Lane will be reviewed due to petition for blacktop and safety concerns.  Vision triangles will be checked during the review.

 

Delmar discussed Quarry Road.  Original vote to only do rocks and culverts this year and grind and blacktop next year will stand.

 

Delmar discussed ATV and UTV ordinance again.  Matt says the board will require signatures from any roads that are to be opened.  Matt said we would hold a Public Input meeting before the Town Meeting on November 9th at 6:30 PM. 

 

Matt discussed the need for a Technology Policy.  Matt says that all town board members should have email addresses.  Matt requested adding the Policy to the Annual Meeting agenda for April 2016.

 

Delmar asked if Tamara could do a Facebook page for the Town.  Board members didn’t see any problem.

 

Matt had requested some funds for his purchase of a new computer.  He had used his personal computer since he became Town Chair.  It needed to be replaced.  Delmar made a motion to pay ½ of the $700 cost.  Second by Wally Borchardt and carried.  Matt abstained from the vote.

 

PLANNING COMMISSION – Jesse Kufahl doesn’t have a permit for shed on 73rd Street.  Ray left information for him.

 

PICNIC COMMITTEE- Marian Matsche will have a complete report in November.

NEW BUSINESS-Budget hearing was discussed.  The Clerk wants to set for November 30th at 7 PM.  The Clerk is concerned about budget needs with the Brokaw issue.  If the Town needs to levy more, then the Town Board needs to approve a resolution for dollar amount  and specific use for the levy above the levy limit.  The Clerk will then need to publish the hearing 15 days before the hearing.  The November meeting is the 9th and to avoid Thanksgiving and hunting the Monday after is the 30th.

Chair Bootz read the Resolution to Commence Negotiations with the Village of  Brokaw and Town of Maine for a Cooperative Plan. 

There were questions from the townspeople about financial assistance with the agreement.  The Resolution only authorizes the Town to share in the costs of negotiations and completion of the Cooperative Plan.  Any other costs would be part of the negotiated plan.

After the Cooperative Agreement is completed, each municipality will hold public hearings on details of the agreement prior to final approval.

TOWN OF TEXAS, MARATHON COUNTY, WISCONSIN

A RESOLUTION TO COMMENCE NEGOTIATIONS FOR A

COOPERATIVE PLAN PURSUANT TO WIS. STATS. §66.0307

BETWEEN THE VILLAGE OF BROKAW,

TOWN OF TEXAS AND TOWN OF MAINE,

MARATHON COUNTY, WISCONSIN

 

            WHEREAS, the municipal board of the Village of Brokaw, Town of Texas and Town of Maine have indicated a desire to negotiate a Cooperative Plan between them; and

            WHEREAS, the municipalities recognize the benefits of cooperative planning under Wis. Stats. §66.0307; and

            WHEREAS, Wis. Stats. §66.0307 provides for a procedure for the negotiation and approval of a cooperative plan between adjoining municipal entities; and

            WHEREAS, the Town Board of the Town Texas, Marathon County, Wisconsin, desires to commence negotiation of a Cooperative Plan with the Village of Brokaw and the Town of Maine.

            NOW, THEREFORE, BE IT RESOLVED that:

1.         The Town Board of the Town of Texas by this Resolution formally indicates its desire and intent to commence the procedure specified in Wis. Stats. §66.0307 for completion of a Cooperative Plan with the Village of Brokaw and the Town of Maine.

2.         The Town of Texas shall bear all of its costs in the negotiation and completion of the Cooperative Plan and intends that the Village of Brokaw and the Town of Maine will be responsible for each of their respective costs in doing so.

3.         The members of the Town Board shall be the parties responsible for negotiating the terms of the Cooperative Plan on behalf of the Town of Texas with the Village of Brokaw and the Town of Maine.

4.         The authority given to the Town Board to negotiate and complete a Cooperative Plan with the Village of Brokaw and the Town of Maine shall extend for a period of at least 120 days from the date of passage of this Resolution.

5.         The anticipated date for completion and approval of the Cooperative Plan shall be 180 days from the date of passage of this Resolution.

The foregoing Resolution was duly adopted by the Town Board of the Town of Texas by a vote of _3_ in favor and _0__ against, on this 5TH day of _OCTOBER, 2015.

 Minutes of the August 10th meeting were read by the Clerk. Delmar Winter moved to approve the minutes.  Second by Wally Borchardt and carried.

Treasurer report was given by the Treasurer Marian Matsche.  Motion to approve and file for audit by Delmar Winter, second by Wally Borchardt and carried.  Delmar questioned the $10 credits on the report.  The Clerk reviewed the bank statement and the credits were credits for receiving statements electronically not by mail.  Wording on reports were confusing.

CHAIR REPORT-Chair not in attendance and no report was given.

 

 SUPERVISOR REPORT-Wally reported that Granite Road was blacktopped today.  Seal coat was completed by Scott Construction.  There may be a bill for washed out areas.

 

CLERK REPORT-Nothing special.

 

OLD BUSINESS-Delmar discussed with Kevin about the 33rd Street culvert and undermining caused by water wash out.  The culvert has some rust but should last years.  Discussion was about repair or replacement.  Motion by Delmar Winter to have Abraham dig and repair the culvert without replacement.  Second by Walter Borchardt and carried.

 

Discussion on Quarry Rd and N 69th Street.   Rocks, and culverts to be fixed this fall with grinding next spring and blacktop during summer.  Ron Stroik has issues if the Town is going to raise the grade by his house again.  They had redone the intersection and raised the grade before.  Ron feels that Quarry Road should be done only to the previous repair until the rest of Quarry Road is done in the future.  The roads issues and the intersection were tabled until Chair Bootz is in attendance.  Motion to table by Delmar, second by Wally and carried.

 

Tires for loader quotes were reviewed.  Delmar Winter moved to purchase Bias tires from Triple M for $4100.  Second by Wally and carried.

 

Delmar brought up the issue of ATV and UTV ordinance.  Delmar said we had a hearing, the referendum past, and the board approved.  The Board should pass the original ordinance without further Attorney discussion.  The Snowmobile club says the town doesn’t need a 4 wheeler club.  Wally doesn’t think opening some roads and not others will work.  Delmar said we have worked on this for 18 months, another month will not hurt.  Issue tabled.

 

Paser program and road rating was discussed.  Clerk needs to file report by December 15th.  Paul Anderson recommended taking Kevin or Rich on the review since they drive the roads every day.

 

PLANNING COMMISSION – Nothing new

PICNIC COMMITTEE- Marian Matsche will have a complete report in October.

 

FIRE DEPARTMENT-Money was made on the raffle.  A new fire sign was installed on the Municipal Center.   Robin Siikarla is our inspector for businesses.  He has requested  50% of training which will be $130.00.  Motion by Walter Borchardt and second by Delmar Winter and carried.

 

BUILDING COMMITTEE-After picnic, some reports on poor conditions in the bathrooms were received by picnic committee members.

 

NEW BUSINESS-Philip questioned what the town is doing with the $6000 from the old tractor sale.   He wants the town to purchase a roller.  Kevin says better to rent one from Blackline and not buy a used roller.

 

Policy for computers/electronics for town officials was tabled.  The supervisors did approve reimbursement for Marians computer repair.  They did not approve the purchase of the Town Chairs computer.

CHAIR REPORT-Chair read the timeline for Brokaw that was received from Brokaw Attorney Dietrich.

Attorney Frojker, Vanderwaal and Chairs from Maine and Texas approved the timeline.

They also will meet with Peoples State Bank.

Granite Road should be blacktopped by end of August.  Matt will contact RC Pavers to have completed as soon as possible.

 SUPERVISOR REPORT-Wally reported that the end loader needs new tires.  Chip Seal repairs should be done soon.

Delmar reported that Dale Kersten would like to know if N 97th Street can be open to ATV and UTVs.  Matt wants to talk more with legal counsel on ordinance and functions to allow each road at a time.

OLD BUSINESS-Granite Road issue.   Zelenkas and Patti Welle and others were present to discuss grinding roads and leaving over winter.  They were very unhappy with Granite Road still not blacktopped after grinding last summer.  They believe that roads can be ground, redone and blacktopped in the same summer without any issues, because the county does it all of the time.  The County never leaves a road gravel over winter.  After much discussion, Delmar said he would reverse his original decision to grind and leave over winter.  Quarry Road would be a test road for the change.  Delmar made a motion to dig culverts and rocks this year but wait until spring to grind and blacktop in 2016 not leaving the gravel settle over winter.  Second by Matt Bootz.  Motion passed with Wally casting a nay ballot.

PLANNING COMMISSION –Clerk had copy of Survey map of Kenneth Borchardt that separates his house and business.

PICNIC COMMITTEE- Janet Sann will set up schedule for volunteers.

BUILDING COMMITTEE-On hold until Brokaw issue is settled.

NEW BUSINESS-Marian requested the Town pay for her to attend the Towns Association meeting in the Dells.  It would be 2 nights at $70, registration and $40 for banquet.  Motion by Matt Bootz to pay for one night, registration and banquet.  Second by Delmar Winter and carried.

 Minutes of the June 8th meeting were read by clerk.  Delmar Winter made a motion to approve the minutes. Second by Wally Borchardt and carried.

Treasurer report was given by the Treasurer Marian Matsche.   Delmar Winter made a motion to accept and file for audit.  Second by Wally Borchardt and carried.  Delmar requested that Marian check on Pomasl fire department costs.  Delmar also told Marian that the Fire Department wants the $315.87 and 301.84 transferred from the Brokaw Credit Union Fire Department account to the Town General Account to cover special expenses.

CHAIR REPORT-Chair requested that Wally, Delmar, Kevin and Clerk get together to finalize Flood Damage Reports for state reimbursement.

 

SUPERVISOR REPORT-Supervisor Borchardt reported that blacktopping of Granite Road is waiting until hauling for new house is done.  Supervisor Winter reported that the Fire Department has increased cost of water for pools from $125.00 to $150.00.  Board approved.  Belt sander was approved so Wally and Delmar can check on prices and order.

 

CLERK REPORT-The clerk noted  a letter from the Marathon County Solid Waste Department that a payment would be received since the state has reduced its funding.

 

OLD BUSINESS-Wally to talk to Scott Construction on seal coating date for North Troy and N 73rd Street which are to be redone due to poor coating last summer.

 

Chair Bootz will contact RC Pavers for paving of Granite Road.

 

PLANNING COMMISSION –Kenneth Borchardt attended to discuss separating his house and business.

NEW BUSINESS-Chairman Matt Bootz reported on meetings that he attended with Brokaw and Maine.  They had worked with Senator Petrowski on legislation to allow a Town of less than 2,300 population and a Village of less than 300 to incorporate with a simple majority vote.  Maine is interested in incorporating to a village, annexing the Village of Brokaw which would allow retaining the TIF district with the tax incentive, protect its border, and be able to apply for more financial aid, economic grants, and work with the DNR on contamination issues in the Brokaw Wausau Paper properties .  Maine would take all of the Village of Brokaw.  The Town of Texas would need to levy more taxes to use as loans to the Village of Maine until they get everything situated and plans worked out.  The Town will have a Boundary Agreement with the Village and a cooperative agreement on the work plan and issues.

SUPERVISOR REPORT-Supervisor Borchardt reported that the culvert  on Forest Hill Road was replaced.    Wally also talked to ABJ and has a reduced cost for ¾ inch base. 

Split Rock Lane only is a town road until about David Greene.  Al l fire signs for houses on the private portion of road are at the end of the Town Road.  This could be a safety issue during fires, or emergencies.  Matt said for safety signs should be at each house not where the town road ends.

 

CLERK REPORT-The clerk noted that an invoice was prepared for the Joint Marathon County Towns Association meeting on July 30th if board wants to attend at Rib River.   Clerk also questioned if the town would continue the WI Towns Association membership.  The floor looks great but there was a square foot discrepancy so the bill is higher than proposed.

 

OLD BUSINESS-Wally wanted to know if the town should consider a belt sander to be used for shouldering and save money in long run.  Matt said the town should consider.  Wally made a motion to purchase a belt sander.  Second by Delmar Winter and carried.

Further discussion on pulverizing and let set for over winter.  Jim Greisbach County Road Commissioner said it is not necessary.  Milt felt that the grader operator should work with weather and 2-3 months during summer and then blacktop.  Kevin says it should lay all winter. Residents have many complaints of rough road, flying rocks, and lack of grading.  Wally says do things as before.  Philip said grade every 2-3 days.  We don’t have the same equipment as county to do all in one year.  Delmar Winter moved to pulverize and leave for winter.  Second by Wally Borchardt and carried with a nay from Bootz.

ABJ will do shouldering of Granite Road.  Wally Borchardt made motion.  Second by Delmar Winter and carried.

Brokaw issue will be discussed at a special meeting on July 13th after the regular board meeting.  The Clerk should publish as a Class 2 notice.  Matt would like guidance from the public on three choices  (1) Cooperative Agreement between the Village, and Town of Texas and Maine, (2) talk more with the City of Wausau on an agreement, (3) litigation as unconstitutional creating taxation without representation.  Numbers and cost meetings of Board will be held prior to hearing.  Decisions need to be made prior to September.  City Council meeting was taped and available through Marathon  Government website.  City Council has issues within its own members on the Brokaw Issue.   Peoples Bank needs to be approached on the lose/lose situation.

There had been a discussion on blacktopping of parking areas around the municipal center to reduce dirt in town hall.  Quotes were requested.  Matt said too expensive and Beth Allman agreed.  Beth thought maybe better gravel and not just sandy dirt would help the situation.   Matt requested to wait until March 2016 and bring up again after the Brokaw issue will have some stability.

The ATV/UTV ordinance was discussed again.  Matt talked to Griesbach about opening County Road WW from Trappe River Golf Course to County Line Rd.  Matt said that an ATV club needs to be formed to work with signs etc.  It was noted that JD Parker would consider working with town residents.  He is currently a Trail Ambassador in Lincoln County and has taken all tests and certifications.  Matt thinks that a club would take the sign responsibility from the Town.   Delmar said he had more than 2/3 approval on roads now signed.  Matt told Delmar he should take the lead on the Project.

 

Boat Landing question- Matt said he is not going forward to spend money on cleaning the road way in Granite Heights to make a boat landing.  Matt said the town will keep the ownership of land, but not clean or clear.

 

PLANNING COMMISSION –Matt noted that we have enough people to fill positions and Matt will step down from the Commission and as Chair.  Jim Burgener as former Marathon County Zoning Administrator will Chair the Commission, and Matt appointed Keith Plautz to fill Matt’s position.

 

PICNIC COMMITTEE-Marian reported that Janet Sann will head the Town Picnic again.  It is set for September 12th at the municipal center rather than the park. Daniel Gruetzmacher will provide music.

 

FIRE DEPARTMENT-Milt said that a Smokey Bear sign grant would be applied for with the DNR.  If we apply for the grant and receive a grant the sign needs to be placed.  Tabled until next March.

 

BUILDING COMMITTEE-Other than checking into the blacktopping of parking area and waxing the floor, any other needs will be tabled.

 

NEW BUSINESS-Liquor license applications were  discussed.  BK Corners, Texas Rec-Trappe Golf Course and Wausau Skeet and Trap were approved, if all paperwork is completed.  Motion by Matt, second by Wally and carried.

 

Employee wages were discussed.  Matt made a motion to give a raise of $.75 per hour beginning on July 1  Second by Delmar Winter and carried.

 

Delmar Winter brought up all of the work that Linda Graykowski does on the Town park.  Delmar says she doesn’t want anything, but made a motion to give her $25/month for 6 months each year.  Second by Wally and carried.

 

Discussion by Wally on private end of Lockwood Lane.  Wally feels town should get highway aids on the end since we plow it.  To get Highway aids, the town needs to own the property and would have to have a CSM now to get the ownership.  The cost would not be covered by the aids received. End of conversation.

SUPERVISOR REPORT-Delmar questioned when Forest Hill would have the culvert installed.  Matt said when Abraham Trucking has time to dig it in.  Split Rock Lane was graded but the rain still washed down the road and into the creek by the culvert.  Delmar questioned soft spots on N 49th Street and when it would be fixed.  Matt said that in areas, the town dug out mud and replaced with rock and those areas seem ok.  Other areas have issues but until the board comes up with a long term fix, not much will be done.

 

CLERK REPORT-The clerk had a reminder for the Board that this is the year for the WISLR Road report.  She also had a notice from the Town of Wausau on a hearing to update Zoning Code.

OLD BUSINESS-The board members discussed the blacktop bids.  RC Pavers had the lowest bid per ton but calculated more tons to do the job.  Matt questioned why the town should trust his work after the Shady Lane Rd issue. RC representative said they could do testing-both quality and density which would cost them, but prove any issues are not because of their product.  Andy Walters said a quality test usually is a test of the material at the lab, density measures pounds per cubic foot to test the rolling and patterns.  Andy also said that the problems Maine had were 50% sub grade issue and poor shoulders.   Matt made a motion to accept the bid with qualification that both tests are done, and a pallet of crack sealant be paid for because of Shady Lane Rd.  A written agreement will be done by RC Pavers and Chair Bootz.  Second by Delmar Winter and carried.

 

Matt discussed that some residents on Granite Road were unhappy to have the road pulverized and left through the winter.  The County does not grind and leave over winter.  Matt wondered if our policy isn’t necessary.  Residents said they had issues with rocks and rough surface.   More discussion at next meeting when Wally is present.

The representative said his bids were qualified that they were only valid if they also got the blacktop bid which they did not.  Any decision tabled.

Brokaw Issue was discussed.  The next meeting is Wednesday May 13th 6 pm City Hall Council Chambers at 407 Grant S Wausau, WI

 

Blacktopping of the parking area around Town Municipal Center was discussed.  Clerk should publish for bids, but Chair and Supervisors need to measure and give information for the publication.  We can call a special meeting to review.

 

ATV/UTV ordinance and issues were discussed.  State Law doesn’t allow under 16 on roads without a legal adult.  Philip has issues with 4 wheelers on Buck Trail Road and doesn’t want other roads opened.  There are two issues 1. Kids are not legal on road. 2 After the non binding referendum, do we want to open more roads when and if 2/3 approval of residents on road, and a method to pay for signs have been submitted.

 

PLANNING COMMISSION -Planning Commission members-Marsha Schultz, Delmar Winter, and Kim Ullenbrauck are removed.  Jim Burgener, Philip Walters, and Bill Schwede were appointed to fill the vacancies.

Meeting was called to order by Chair Matt Bootz.  This meeting was held with the Town of Maine, Village of Brokaw and City of Wausau participating.  Each municipality introduced municipal officials in attendance.

City of Wausau-Attorney Anne Jacobson, Dave Oberbeck, Tom Neal, and Robert Mielke

Village of Brokaw-Attorney Dean Dietrich, Jeff Weisenberger, Wayne Utecht and Adam Dykman.

Town of Maine-Attorney Randy Frokjer, Betty Hoenisch, Keith Rusch and Tad Schult.

Attorney Dietrich started with a handout from Brokaw with current services, desires, concerns, and options.  He requested that we proceed with future and not past history.  The Village needs to clearly notify of its decision to no longer remain a Village and look at the options.

City of Wausau-Dave Oberbeck said the City is willing to listen and learn about the issues, problems, and possible options.  The City looks at the Economic Development potential if it is beneficial to the City taxpayers. 

Open mindedness is essential to cooperation.  Some issues include

1)      June 2016 deadline

2)      TIF would not transfer to the Towns within current law

3)      Possible impacts on each muni for each option needs to be worked out

4)      City sees no option for a string-balloon  annexation or agreement

5)      Cooperative agreements could still be option

6)      State believes that a Cooperative Boundary Agreement is the best option

 

Town of Maine chair would like to work on best option but isn’t sure what that might look like.  Her town residents are not supporting any annexation or giving up town property.  Betty feels a lot of the Brokaw Issue started with the City providing the water to the Village.  There were other water options at that time.

Tom Neal reminded the boards that a Cooperative Boundary Agreement is not an annexation and comes under other chapters of state law.  Consolidation is another option under other portions of state law and will be reviewed.

The City representatives requested additional solid information on the Village Debt to help in calculations of costs of options to each muni involved.

Attorney Frokjer wanted more information on the water systems and possible cost reductions.  The landfills Cell 1-4 were discussed as potential costs from contamination.

City says all options need to be reviewed as “dreams” or viable.  Attorney Dietrich recommended that each municipality prepare a list of “like to see” or include in a potential Cooperative Boundary Agreement and meet again.  Meeting set for May 13th at 6 pm in City Hall Council Room.

City members said they appreciated bringing the City to the Table and understand that it can be contentious.

Texas Clerk said that the towns may have added to citizen concerns because we have made assumptions on what the City would want to take.  Those assumptions of the Texas panhandle, and Maine from City to Brokaw east of County Road K have gotten citizens more concerned than may  need to be depending on City considerations and possible agreements.

Meeting was called to order by Chair Matt Bootz.  Delmar came late then all supervisors were present.

 Matt said that culvert was ordered to fix Forest Hill Road.  We use the area to turn around and the culvert is split and is a safety issue.  Wally called Paul Falkowski about the issue since it is on his property.  He said he would contribute to the cost.  The town uses the area for a turn around since the road is dead end and a hill that a plow truck could not back up on.  Town of Wausau Riehle said they would contribute because we plow the end of N Ridge Road which is really Town of Wausau road.  The Town will have Abraham install and then charge back costs to other contributors.

Chair Bootz said that Wally as senior supervisor is now the supervisor of the highway crew.  Delmar will work on the signs as the secondary supervisor.

Blacktopping was discussed.  Matt will talk to RC Pavers about a bond prior to contract and 2 pallets of crack sealer to cover issue with Shady Lane road.

Wally reported that Matt Taylor would charge $1320 to wax the floor.  He has no insurance so the town would have to treat him as an employee and pay social security, medicare, and workmans comp insurance.  Quality House Carpet cleaning by Jim Bogie is insured and would do 5 coats for $1000.

Philip reported that Scott Construction has swept the seal coating, and will sweep again in June.

Meeting adjourned and board left for the Town of Maine Hall for meeting with City of Wausau on the Brokaw Issue.

SUPERVISOR REPORT-Wally questioned having the floor waxed.  Milt said should wait and have the parking lot blacktopped first.  The repair of base on the municipal center was questioned.  Cary had not given an estimate.  Philip said take care of the floor and then work on base and blacktop.  The tile needs to be waxed and protected.  Philip Walters made a motion to have floor waxed.  Second by Wally Borchardt and carried.  Wally will get estimates on the floor. 

 

CLERK REPORT-Nothing special.

OLD BUSINESS-Problems with 4-wheelers on Buck Trail and N 33rd St since signs were posted.  There have been close calls with kids on 4 wheelers.  The kids are not stopping when entering roads and have almost caused accidents.  They are not 16 and not legal to be on the roads.  Various parents will be communicated with to stop the issues.

 

Blacktop bids were discussed.  Philip Walters said the RC Pavers had not used enough trucks on Shady Lane Rd which caused problems because the blacktop didn’t knit together when the trucks lagged.  No decision was made.

 

Philip reported on the 2014 seal coat job.  Dan Luoma and Sean Cummings from North Troy Street attended to discuss problems on N Troy with the aggregate in the lawns and loose on the road.  Philip had contacted Scott Construction and they will sweep ditch lines and roads of N Troy and N 73rd Street to remove the excess aggregate.  Scott Construction plans on a redo of  the project which was too late last fall and didn’t adhere properly.

 

Flood damage reports tabled until landscaping is finished.  No bids were received for grinding or shouldering so Chair will contact contractors.

 

NEW BUSINESS-More discussion on blacktopping of the parking around the front and side of the Municipal Center.  Estimates will be requested and budget will need to be reviewed.

 

Annual meeting agenda was discussed.  Most items like last year.  Clerk will type up an agenda, but it is the meeting of the electorate and other items can be discussed.

 

FIRE DEPARTMENT-A raffle will be done again this summer.  The Department decided to do the raffle even if the Town doesn’t have a picnic.  Discussed replacing Delmar as an officer now that he is a supervisor.  Bill will take care of at next meeting.  Recommendation to town board to have sign painted as part of renovations.

 

PICNIC COMMITTEE-Requests were for earlier like in July, also others thought fall would be better.  Nothing is set for 2015.

SUPERVISOR REPORT-Wally reported that there are bad spots on Granite Road and east Green Valley Rd.  These roads should be reviewed.

CLERK REPORT- Salt inspection will be done.  County surveyor wants report on road work for 2015.

OLD BUSINESS-Open blacktop bids for Granite Road. 

RC Pavers-2,043 tons @ $52.13 per ton for $106,501.59

American Asphalt-1982 tons @ $52.97 per ton for $104,986.54

Chair Bootz accepted the bids but wanted to table any decision until after the new board takes office after the Election and Annual  Meeting.  Bootz made a motion to table until a Special Board meeting the night of the Annual Meeting April 21st.  Second by Philip Walters and carried.

 

Seal Coating is peeling on N 73rd St.  Done too late in fall and too cold.  Will Contact Scott Construction.

Motion by Chair Bootz to request bids for grinding 69th Street and Quarry Road from Granite to N 81st St, also request bids for shouldering of Granite Road after the blacktop is done.  Second by Wally Borchardt and carried.

 

Flood damage report will be submitted after some final work this spring.

Set audit meeting for March 16th at 7 pm.

Annual meeting lunch purchases will be done by Treasurer.  Eastern Towns will be done by Clerk.

Copy of minutes that approved 33rd and Buck Trail temporarily for ATV/UTV usage should be sent to the Sheriff.

Clerk asked about notices to be included on the Annual Report.  The referendum should be included, and the Brokaw Open Q&A forum (wording to get from Attorney)

Brokaw issue was discussed.  There is an open meeting on March 23rd at 5 pm at Maine Town Hall.  There will be an Open Joint Public Question and Answer Forum March 30th 7 pm at the Maine Town Hall.  Chairmen from Maine and Texas will have a press release at that time.

 

The City Finance Committee set 5 principals

1.       Provide services to only City Taxpayers

2.       No loan or money to others

3.       No purchase of Brokaw utilities

4.       Work for the development of tax base for City of Wausau benefit

5.       Investment needs to positive to cover risk.

 

Maine and Texas Chairs plan to meet with State DOA representatives in Madison to discuss potential legislation. The County study cost  $52,000 which was what Senator Pietrowski wanted, but nothing is being done with it.

Clerk question what is the debt not including the TID.  The amount is unknown at this point.

 

FIRE DEPARTMENT-MABAS needs to be signed.  Clerk needs to get a copy and submit to Town Board.

Annual Dinner went very well.  Bob’s Catering did the meal, drinks available, also games and prizes were enjoyed.

 

PLANNING COMMISSION-Nothing from the meeting, but clerk reported on an email about chickens.  Chickens would be allowed in a residential zone, but not for breeding farms.  Clerk talked with County Zoning on calculation of animal units.  The calculation would allow 500 per acre.  The Residential zone and animal allowances needs to be reviewed and changed.

Meeting was called to order by Chair Bootz.  All members were present.

Minutes were taken by Treasurer Marian Matsche in absence of Clerk Beyersdorff.

OLD BUSINESS-Road issue on stubs that may not be included in town mileages.

Garbage issue-Chair said issue has been better with not as many complaints.

 The ATV referendum was discussed. It is just an advisory referendum.  The referendum will be posted and published in the daily herald. 

Matt will call Scott Construction on the peeling of the chip seal on N 73rd St.

Flood damage report on hold.

Bids for Blacktop will be published by clerk.

Planning Commission- no report.

 Fire Department-Milt discussed Mutual Aid agreements and the MABAS agreements. Chief Schwede says the Town needs to sign.

Brokaw issue was discussed.  Marathon County report was discussed.  Brokaw water issue was discussed.  Matt explained we have had meetings with Brokaw, and Maine.  The water and waste disposal systems were discussed.

Clerk to check on values of the panhandle of the town.

Meeting was called to order by Chair Bootz.  All members were present.

Minutes of the December meeting were read by clerk.  Philip Walters made a motion to approve . Second by Walter Borchardt  and carried.

Treasurer report was given by the Treasurer.   Philip Walters made a motion to accept and file for audit.  Second by Walter Borchardt  and carried.

CHAIR REPORT- Matt reminded everyone that the County Report on the Brokaw issue will be presented at the Courthouse at 5 PM on January 13th.

The garbage collection is still an issue.  IROW will no longer go down long driveways.  Matt said some elderly people have a problem with this.  Matt will help them if necessary.

SUPERVISOR REPORT-The loader rework was expensive but with new pistons, it is better than ever.

OLD BUSINESS-The cemetery road issue was tabled.

The ATV referendum was discussed. The Board had recommended to allow N 33rd St and Buck Trail to be open if 2/3s of the residents approved in writing, and signs were purchased and posted correctly.  The Board still needs to approve and submit to the DNR.

Matt will contact Delmar.  The road is not open until the Board approves and sends approval to the DNR.  Anyone using the roads may be ticketed until all of the details are final.  Philip moved the road is not approved until proof of approval by residents.  Second by Wally and carried.

Chip seal issue was discussed.  N 73rd St and North Troy have peeling issues.  This will be a warranty issue with Scott Construction.

Flood damage reports from September will be reviewed later.  Clerk doesn’t want to forget.

NEW BUSINESS-Chair Bootz requested clerk to publish for bids, the blacktopping of Granite Road the same as grinding.  Bids to be opened in February and rebid if oil prices continue to drop.

Planning Commission was cancelled due to cold weather and illnesses.

Fire Department-Milt discussed Mutual Aid agreements and the MABAS agreements.  Put back on agenda for February.

Picnic Committee no news.

Building Committee-no news, waiting for spring.

Town of Texas Town Board Meeting

December 8th, 2014

Notices were posted at the Municipal Center, Bk Corners, and on the website.

Meeting was called to order by Chair Bootz.  All members were present.

Minutes of the November meeting were read by clerk.  Philip Walters made a motion to approve minutes from November. Second by Matt Bootz and carried.

Treasurer report was given by the Treasurer.  The IRS and Department of Revenue ACH  draws were not on the expense list.  Marian listed them separate.  Lorraine confirmed that these were the draws not listed.   Philip Walters made a motion to accept and file for audit.  Second by Walter Borchardt  and carried.

The reimbursement of education costs was discussed.  The fire department needs a written policy.  Matt had the Attorney draw up contracts for Alison Baker and Sarah Goree to sign if they wanted reimbursement for training above the first responder training.  They will need “C” grades or better and remain with the Town of Texas First Responders for three years or the town will sue for breach of contract for reimbursement.

The Fire Department election results were Chief-Bill Schwede, 1st Lieutenant-Delmar Winter, Secretary-Gina Walters.  Motion by Matt Bootz to approve, second by Wally Borchardt and carried.

Wages for Fire department officers, and volunteers were discussed.  Philip Walters moved to increase the Chief by $1000 and the car expense by $300.  Second by Walter Borchardt and carried. 

Matt Bootz moved to increase per diem for attendance at meetings and trainings by $5.  Second by Walter Borchardt and carried.

Matt Bootz moved to transfer  fund raising money to Brokaw Credit Union into the savings account.  Also, any funds in the checking account at BCU should be moved to the savings account for fire department special purchases.  Second by Philip Walters and carried.

Planning Commission has been quiet.  Bootz purchased new plat books for Town Board members.

Picnic Committee no news.

Building Committee-no news, waiting for spring.

Discussion about riding across pipline and then down town road.  The town could open the road, but not the private land.  What if the pipeline owner decides to stop  those riders crossing his land.

Should the Town still consider a referendum?  Philip Walters moved to approve roads individually when the signage is purchased without town funds and put up.  Wally Borchardt seconded the motion and it carried.

Matt discussed issues with IROW.  Corey is having issues with trucks and drivers, and since we pay less than others, it is our service that is suffering.  Attorney says it could constitute a breach of contract.  If that happens, then we get other bids, and IROW would have to pay difference.  Matt will wait and see what happens from here on.

Question by Beth Allman on free use of the Town Municipal Center.  She has been questioned about the Snowjet Club.

The Board agreed that 4-H, Homemakers,  Fire Department, Planning Commission and Board meetings are free.  In addition Philip made a motion to allow free use for the Snowjets since they provide a community service and most of the club are town residents.  Second by Wally Borchardt and carried.

Town of Texas Town Board Meeting

November 10th, 2014

Notices were posted at the Municipal Center, Bk Corners, and on the website.

Meeting was called to order by Chair Bootz with Wally Borchardt excused.

Minutes of the October 6th and 13th meetings  were read by the Clerk.  Matt Bootz made a motion to approve the 6th minutes.  Second by Philip Walters and carried.  Philip Walters made a motion to approve minutes from October 13th. Second by Matt Bootz and carried.

Treasurer report was given by the Treasurer.  Philip Walters made a motion to accept and file for audit.  Second by Matt Bootz and carried.

Chair Report-Problems with Castle Rock and North Troy Street during winter weather. The road should have not been built at the angle and T intersection.  Shouldering is done.  January 17th is the Public Hearing on the Brokaw report, Chip Seal on North Troy still creates calls, Seth Graykowski cleaned Jesse Park and said lot of dumping there. 

Issue about Marshall Hill Bridge replacement because Fire Department should have been notified of road closure.

Rip Rap by bridge to be done, landscaping next spring.

Clerk requested permission to keep garbage and recycling at $110 for 2015.  Granted

Board requested a short meeting Monday the 17th prior to the Budget Hearing.

The assessor contract for 2015 was approved with the adjustments necessary to be in compliance.  Motion by Matt and second by Philip and carried.

Fire Department-Issue with reimbursement for classes taken without permission.  EMT classes should be reimbursed only if contract to stay in with the department for 4-5 years and meet 50% of calls.  Matt will work with Shane on a contract similar to discussion.

Fire Chief is requesting a raise with all of the duties and reports.

Janet discussed the need for a dedicated phone line for the fire department because of the fax needs.  Tabled until next week when Wally is back.

Fire Department dinner at Town Hall like the previous years was approved by Board members.

Fund Raising money of the fire department was discussed.  Should it be moved to the Brokaw Credit Union fire department account for special purchases.  Tabled until Wally is back next Monday.

Fire Department lock will have code changed.  It has been the same for years and many members have come and gone.

Picnic Report-nothing

Delmar Winter brought up his request for N 33rd and Buck Trail to be opened for a temporary access route between Hay Meadow Road and N 33rd by Town of Wausau line.  It is ok for snowmobiles, but Delmar wants approval for 4 wheelers also.  Cost of signage will not be by Town funds.  Matt will talk more with Shane and Wally about opening one road at a time or all or no roads.

Old culverts were sold for $50 a piece to clean them out.
